• The industry is a medium scale orange category unit.
• The industry was granted consent to establish (NOC) under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 valid upto 26.05.2021 for manufacturing of Fruit Juice @ 20000 Liter/day by using Fruit Pulp @ 1 Metric Tonnes/Day Sugar @ 0.4 Metric Tonnes/Day as raw material with special condition that:
1. The industry shall obtain the necessary permission from the concerned Departments, if required, if any, in the future at its own level.
2. The industry shall make proper & adequate arrangements for segregation and scientific disposal of solid waste in compliance with MSW Rules along with the commissioning of the unit.
• Thereafter, the industry was visited by AEE of this office on 11.07.2023 and observed as under:-
1. The industry was in operation during the visit and engaged in the manufacturing of fruit juices and cold drinks.
2. The industry has installed wood-fired boilers of unknown capacity with adequate stack height and sampling arrangements.
3. The industry has installed ETP of unknown capacity which was not in operational condition. The components appear to be non-operational for a long-time and a bye-pass arrangement has been provided from the collection tank to the previously vacant lot with the flexible pipe.
4. The effluent was found to stagnate in the previous vacant plot. There was no approach to the said plot due to which the sample could not be collected.
5. As per the site plan submitted by the industry while obtaining Consent to Establish, the said plot is not within the premises of the industry.
6. There was no ETP Sludge present during the visit which indicates the non-operational condition of ETP.
7. The industry is selling Fruit Juices, Water bottles, and cold drinks in plastic containers but has not obtained Registration under Plastic Waste Management Rules, 2016.
8. The industry has failed to produce permission from PWRDA for the abstraction of groundwater.
9. The plastic waste was observed being burnt at the backside of the vacant plot.
10. The industry is operating without any valid Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 from the Board.
• Thereafter, the industry was given personal hearing before the Chief Environmental Engineer, Jalandhar on 24.08.2023 u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and 31-A of under Air (Prevention and Control of Pollution) Act, 1981, wherein it was decided as under:-
1. The industry shall operate the ETP regularly & efficiently, so as to achieve the prescribed standards and shall ensure that there is no stagnation in side its premises or adjoining it due to operation of the unit.
2. The industry shall apply for renewal of consent under the Water (Prevention & Control of Pollution) Act 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 15-days.
3. The Environmental Engineer, Regional Office shall personally visit the industry verify the compliance made by it, collect effluent samples and send report/ recommendation, within 01-month.
• Now, the industry has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS of the Board for manufacturing of Fruit Juice @ 20000 Liter/day by using Fruit Pulp @ 1 Metric Tonnes/Day Sugar @ 0.4 Metric Tonnes/Day as raw material and detail of the same is as under:-
1. The industry has Rs. 1,62,000/- vide UTR No. SDL135257066 dated 19.07.2023 under Water Act 1974 and Rs. 1,62,000/- vide UTR No. SDL135357087 dated 19.07.2023 under Air Act, 1981 against the fixed assets of Rs. 809.26 lacs, which are adequate upto 30.09.2027 including NOC regularization fee.
2. The industry has submitted approved building plan from Competent Person under Factories Act, Punjab.
3. The industry has submitted manufacturing process, feasibility report of ETP, partnership deed, registry of the land, list of partners with the application.
4. The project proponent has uploaded the CLU certificate issued by STP, Jalandhar letter no. 2140 dated 16.08.2019 the permission has been granted for setting up of industry fruit juice (beverage) at village Raowali, Jalandhar of 0.90625 acres area.
• The industry was visited by the AEE of this office on 27.02.2024 and it was observed that:
1. The industry was in operation during visit and engaged in the manufacturing of fruit juices and cold drinks.
2. The industry has installed ETP based on MBBR Technology at site for the treatment of untreated effluent generated at site but same was not in operation during visit, hence the effluent sample could not be collected. The components of the ETP appear to be non-operational for a long-time and a bye-pass arrangement has also been observed from the collection tank of the ETP leading to the adjoining vacant plot for stagnation.
3. The industry has not developed any plantation area for utilization of trade effluent till date.
4. There was no ETP Sludge present was seen in the sludge beds during the visit which indicates ETP was not operated by the industry on regular basis and has failed to produce any records regularly operation of ETP during visit.
5. The industry has installed one wood fired boiler of capacity 1.5 TPH with cyclone as APCD with adequate stack height and same was in operation. The industry has not provided sampling arrangement with the boiler stack, hence the air emission sample could not be collected.
6. The industry is selling Fruit Juices, Water bottles, and cold drinks in plastic containers but has not obtained Registration under EPR Rules.
7. The industry has failed to submit permission from PWRDA for the abstraction of groundwater.
8. The industry is not complying with the conditions under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981.
The industry is a medium scale orange category unit and competency to decide such case lies with Chief Environmental Engineer, Jalandhar.
Keeping in view of above, it is recommended that fresh of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention and Control of Pollution) Act, 1981 may be refused.
