1. There has been an increase in assets as reflected in comparison made b/w CA certificates submitted vide application under consideration and previously submitted with earlier granted CTO application. Pl clarify, how is merely a case of transfer of ownership and not expansion?
Reply - The industry has submitted reply wherein it has been mentioned that due to the transfer of sale deed, there is increase in the fixed assets of the industry. Further, the industry has submitted and affidavit, wherein it has been mentioned that the industry has not increased in any land area and the land area is same since the commissioning of the unit. The same has been verified during visit the site by the undersigned.
2. Check whether sale deed for transfer of ownership of the industry has been submitted.
3. Has the industry submitted dissolution of earlier partnership deed ?
Combined Reply 2 & 3 – The industry has submitted an agreement dated 9.06.2023 between its previous partners (Sh. Munish goyal S/o Sh. Yashpal Goyal & Sh. Jiwan Goyal S/o Sh. Bant ram) and Sh. Subash Goyal (now prop. of the industry) regarding transfer of all the assets & liabilities of the firm including building, machinery and land measuring 12 bighe 19 biswe and 6 biswasi (copy enclosed).
4. Has the industry submitted Prop. Certificate of new owner ?
Reply - The industry has submitted Prop. Certificate in the name of Sh. Subash Goyal (copy enclosed).
5. The industry was established in 12 bighe 10 biswe as evident from file record, but the revenue record submitted vide application under considerations reflects 6 bighe 9 biswes 8.8 bishasia. Pl clarify.
Reply - The industry has submitted following land records:
1. Land area measuring 6 bighe 9 biswes 8.8 biswasia registered vide no. IN PB98619510907360V dated 12.05.2023in the name of Sh. Subash Goyal, Prop. of the industry (copy enclosed).
2. Land area measuring 6 bighe 9 biswes 8.8 biswasia registered vide dated 29.05.2023 in the name of Sh. Subash Goyal, Prop. of the industry (copy enclosed).
Hence, as per above mentioned land record, the total land of the industry is 12 bighe 18 biswes 17.6 biswasia. As per the record file, there has been an increase of 8 biswe 17.6 biswasia which is due to updation of jamabandi after 5 years and hence there is no increase in land area, which has also been verified during visit to the industry at the site.
In view above, it is recommended that consent to operate granted under the Water Act, 1974 & the Air Act, 1981 may be granted upto 30/09/2024 for manufacturing of Sorted Raw Rice (without dryer) @ 2.0 TPH by processing of Paddy @ 3.0 TPH, as raw material under orange category, subject to certain conditions to be mentioned therein and a special condition that the industry will got analyzed its stack emission samples from the Board's lab or Board's approved lab in coming season.
