The detailed note of the case is as under:
The industry was granted consent to establish (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981 on 26.10.2022 (valid upto 25.10.2023) for establishment of Card Board/Mix Board @ 08 TPD by using ETP sludge of pulp & paper mill as one of the raw material......... • Now the industry has applied for obtaining consents to operate under the Water Act, 1974............ • The industry was visited by the Regional Office of the Board on 13.02.2024 and no violation has been reported under the Water Act, 1974 & Air Act, 1981 as well as w.r.t. code of practice prescribed for such type of units............. • A civil suit bearing no. 777 of 2022 has been filed by Sh. Rajbhuinder Singh S/o Sh. Sukhmander Singh in the Hon'ble Court of Civil Judge, Senior Division, Mansa, regarding permanent injunction to restrain the establishment of card board/gatta factory, wherein the Board is a respondent in the matter. The reply in the matter has already been filed by the Board and the next date of hearing is 04.03.2024......... • As no violation reported under the Water Act, 1974, if approved, consent to operate under the said Act be granted to the industry for six months for production of Card Board/ Mix Board @ 08 TPD by using ETP sludge of pulp & paper mill as one of the raw material, subject to the following special conditions:-......... 1. The industry shall not procure and process any hazardous waste as prescribed in Schedule-I appended to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 till it gets the certificate of registration / passbook as recycler /re-processor from the Board............. 2. This consent to operate is valid only to facilitate the industry to obtain registration/passbook as recycler /re-processor from the Board as required under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016, which shall be obtained during the validity period of this consent.............. 3. The industry shall apply afresh for obtaining consent to operate as required under the provisions of Water Act, 1974 & Air Act, 1981 after obtaining certificate of registration / passbook as recycler /re-processor from the Board................ 4. The industry shall comply with the standard operating procedures framed by CPCB for utilization of process & primary sludge of ETP of pulp & paper industry................5. The industry shall be bound to comply with outcome of the Civil Suit no. 777 of 2022 pending in the Hon'ble Court of Civil Judge, Senior Division, Mansa.
