It is submitted that the industry the industry was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide nos. CTOW/Varied/MKS/2019/8621504 and CTOA/Varied/MKS/2019/8621429 both dt. 22.03.2019, expired on 31.03.2023 for operation of the unit to produce rice bran oil @ 10 TPD & rice bran extraction @ 50 TPD under the name of Evershine solvex pvt.ltd., Jalalabad road, Sri Muktsar Sahib with special condition that the industry will ensure the treatment of trade effluent in the common ETP installed in its sister concern unit M/s Ekam Agro Pvt. Ltd.
Another sister concerned unit of the industry namely Ekam agro pvt. ltd., Jallalabad road, Sri Muktsar sahib was earlier granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 upto 31.03.2022, for operation of the unit to produce Refined Oil @ 72 TPD (OR) Refined vegetable oil @ 49 TPD.
Now Sh. Dapinder Singh Dhillon, Director of M/s NAAJ AGRO FOOD PVT LTD, Jalalabad Road, Sri Muktsar Sahib has submitted a letter stating that they have purchased land 87 Kanal 10 Marla through NCLT E-Auction in which Building and Plant & Machinery already installed. It is further certify that Solvent Extraction Unit, Refinery, Boiler and ETP Unit already installed in 87 Kanal 10 Marla. Sir, we have applied Consent only for Solvent Extraction Unit. Sir, we assure you that we will not running Refinery Unit and we have no objection if PPCB seals the Refinery Unit. We will operate only Solvent Extraction Unit, Boiler and ETP Unit.
Now the industry has applied for fresh consent to operate under Water Act, 1974 & Air Act, 1981 for operation of the unit to produce rice bran oil @ 50 TPD.
The industry has also submitted the CA certificate dated 15.12.2023, wherein, the value of total fixed assets of the unit as on 15.12.2023 is Rs. 444.99 Lacs lakhs. The industry has deposited consent fee of Rs. 21600/- vide R.No. 686705273 dated 02.02.2024 and Rs 19000 on dated 04.03.2024 under the Water Act, 1974 and Rs. 21600/- vide R.No. 464400454 dated 02.02.2024 and Rs 19000 on dated 04.03.2024 under the Air Act, 1981. As such, as per circular dated 29.10.2018, the fee deposited by the industry under both the Acts is adequate upto 30.09.2026.
The industry has submitted the certificate from District Town Planner, Sri Muktsar Sahib vide no. 491 dated 20.07.2023 as per which 87 kanal 10 marla site of the industry falls in industrial zone of Notified Master Plan, Muktsar.
The industry has attached certificates of sale dated 11.07.2023 of land & building and plant & machinery from Mohit Chawla (Liquatdator of M/s evershine solvex private limited) Approved by National Company Law Tribunal, Chandigarh. As per the said certificates land of 87 kanal 10 Marla of sale amount Rs 2.8 crore and plant & machinery (excluding oil tanker) of sale amount Rs 1.77 crore has been sold by evershine solvex to naaj Agro.
With due respect we have purchased land & building and plant & machinery through NCLT E-Auction on behalf of M/s Evershine Solvex private limited in liquidation in favor of M/s Naaj Agro Food private limited.
The industry has submitted letter stating that two steam boilers of capacity 10 TPH and 6 TPH and One Thermo fluid Boiler was already installed on the land of M/s Naaj Agro Food private limited and ETP unit was also installed on above said land.
It is further certified that 40 Kanal land out of 87 Kanal 10 Marals is already under possession of M/s Naaj Agro Food Private Limited. Proper Demarcations has already done by the Patwari (site map enclosed) and case of NCLT was already withdrawn from the court.(Case withdrawn Copy enclosed)
The industry has submitted sale deeds dated 18.08.2023 (sold by liquadtor of Evershine solvex) and jamabandi for the land 87 k 10 M in the name of M/s Naaj Agro pvt ltd.
The matter of Ricela vs Evershine Solvex has disposed off by the NCLT Chandigarh by passing an order that land in question has been already sold under liquidation.
The industry was visited by the undersigned on 29.02.2024 and it was observed as under -
1. The industry was not in operation. The industry has earmarked 87 kanal 10 Marla land of the industry. As per the said demarcation there is solvent extraction unit, refinery unit, ETP unit, plantation area, 2 boilers, 1 Thermopack and some vacant buildings inside the premises. Adjoining to Refinery unit, there is about 4 kanal land of Ekam Agro Pvt ltd in Khasra no. 72//4, 72//5, 72//7 & 62//24/2/1, in the said land bricked stack and some oil tanks were present (pictures attached), said land is not the part of premises of the industry.
2. The refinery plant installed was not in operationable condition as some parts of machinery needs repair or replacement to make it operational.
3. The already installed ETP in M/s Ekam Agro pvt ltd is now falls in 87 k 10 M land. The ETP installed by the industry was found in operational condition and about 4 kanal of land has been developed under plantation for containing treated effluent @ 21.6 KLD (20 KLD treated trade effluent and 1.6 treated domestic effluent), which is adequate.
4. The already installed Boilers of capacity 10 TPH, 6 TPH and one thermopack of 1 lac Kcal in M/s Ekam Agro pvt is now falls in 87 k 10 M land. The industry has installed twin cyclone with rice husk fired 10 TPH boiler, multi cyclone with rice husk fired 6 TPH boiler and cyclone with thermopack of 1 lac kcal. The industry has provide common stack with all these boilers.
5. The industry has made arrangements for handling and wetting of fuel ash of the boiler's and thermopack.
As such, the industry is complying with the provisions of Water Act, 1974 and Air Act, 1981.
Keeping in the view of above, it is recommended that fresh consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 for operation of unit of capacity rice bran oil @ 10 TPD & rice bran extraction @ 50 TPD may be granted to the unit upto 30.09.2026 with suitable conditions along with special conditions that the industry shall not operate Refinery unit without the permission of the Board.
