File Note: It is intimated that the industry is a small scale orange category unit. Earlier, the industry was granted Consent to Operate under the provisions of Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2023/20927735 dated 15.02.2023 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/SAS/2023/20927401 dated 15.02.2023, both having validity upto 30.09.2024 for manufacturing Crushing of river bed material @ 4000 CFT/day as product by using River Bed Material @ 4000 CFT/day as raw material with subject to suitable conditions and special conditions mentioned therein. Now, the industry has increased its production & also added screening plant and has applied for obtaining varied consent to operate under Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing Crushing, Screening & Washing of River Bed Material @ 14000 CFT/day as product and River Bed Material @ 14000 CFT/day as raw material alongwith requisite documents and consent fee. As per record file of the industry the previous consent fee under both acts is adequate upto 30.09.2027 against the total cost of assets is Rs. 46 lacs. Now, the industry has deposited Rs. 9,800/- vide Receipt No. 887994383 dated 24.02.2024 (Rs. 6,400/- under Water Act, 1974 & Rs. 2,900/- as NOC Regularization fee) and Rs. 6,400/- vide Receipt No. 376254537 dated 24.02.2024 under Air Act, 1981, against gross value of fixed assets is Rs. 74.00 lacs. The consent fee deposited by the industry is adequate upto 31.03.2029 under both acts. The industry has submitted revised partnership deed executed on dated 06.07.2023 between S. Sarpreet Singh S/o S. Ajit Singh, Sh. Yoan Gulati S/o Sh. Subhash Chand, Sh. Sikander Lal S/o Sh. Harbhajan Lal, Sh. Madhav Chawla S/o Sh. Satish Chawla for the business of M/s Ajit Stone Crusher. The industry has submitted lease deed executed on dated 02.01.2024 between Sh. Gulshan Kumar S/o Sh. Harbhajan Lal and M/s Ajit Stone Crusher for leasing the land bearing Khewat No. 333, Khatuani No. 472, Khasra No. 601 (4-0), 602 (4-0), 603 (4-0), 604 (4-0), 591 (4-0), 593 (4-0), 594 (4-0), 596 (4-0), 597 (4-0), 598 (4-0), 1445 (0-12), 1449 (0-4), 599 (4-0), 600 (4-0), 595 (4-0), 605 (4-0), Pieces 17, Rakbha 56 Bigha-16Biswa out of 160/1136 Share=Measuring 8Bigha-0 Biswa, which is valid upto 31.12.2039. The industry has submitted revised approved site plan prepared by Er. Sushil Kumar Garg Competent Person from Director of Factories, Punjab on dated 12.02.2024. The industry has also submitted DTP letter issued by Senior Town Planner, PUDA Bhawan, Sector-62, Mohali vide its memo no. 3392-STP (S)/SS-11(G1) dated 08/08/2014 as per which Change of Land use granted for land measuring 1.615 Acre located at Village Hamayunpur (HB. NO. 166), Khasra No. 601 & 602, Tehsil Dera Bassi, Distt SAS Nagar. The permission for change of land use from agricultural to industrial (Stone Crusher & Screening Plant) is granted for establishing the Stone Crusher & Screening Plant. The industry has submitted the distance certificate from signed by SDM, Derabassi vide no. 27/ਸ/NOC dated 21.03.2023 as per which: Sr. No Guidelines prescribed for stone crusher unit Relevant distances as certified by SDM 1. 5 Km from local body limit/MC The site falls outside 15 Km from local body limits. 2. 2 km from city limits of A-Class Town The site is at distance of 27 km from city 3. 1.5 km from city limits of B-Class Town The site is at distance of 15 km from city 4. 500 m from National Highway/State Highway/ Scheduled Road The site falls outside 2 km from National Highway/State Highway/ Scheduled Road limits. 5. 500 m from Phirni/LalLakir/Wild Life Sanctuary / Zoo/ Residential Area The site falls outside 670 m from Phirni/LalLakir. 6. 300 m from Educational Institute/ Historical Religious Places / Protected Monuments The site falls outside 300 m from Educational Institute/ Historical Religious Places/ Protected Monument limits. As such, the industry is meeting with the siting guidelines prescribed for such units. The site was visited by the undersigned on 02.03.2024 and it was observed as under: 1. The industry is engaged in business of Crushing, Screening & Washing of River Bed Material. However, the physical condition of the same is showed that the same is not in operation since long and the industry is currently renovating the unit. 2. The manufacturing process of the industry is as under:- River Bed Material—Washing & Screening—Crushing in different sizes—Dispatch. 3. The entire machinery for the crushing unit has been installed, however, the shed over the jaw crusher is under installation. 4. The industry has provided separate hodi with the crusher and screening-cum-washing plant and also provided pucca road with interlocking tiles from the main premises of unit to hodi. 5. The wastewater arising from the washing of river bed material will be settled in settling tanks and further water will be recycled/reused in the washing plant. There is no drain/ nallah existing near the plant, therefore, it has no option to bypass the wastewater in any stream. 6. The industry has provided rubber flappers/ chutes at the end of the conveyer belt of crusher. 7. The industry has also provided sprinkler at the edge of conveyer belt to suppress the dust emission. 8. The domestic effluent will be discharged onto land for plantation after passing through septic tank. The representative of the plant requested that the work regarding shed over the crusher will be completed in 15 days. However, for mining license and electric connection of a crusher, the CTO of the board is a pre-requisite, which will take another two months. He requested that CTO may be granted to him and assured that the plant will only be operated after compliance of the SOP’s prescribed for such units. In view of above, it is recommended that the consent to operate under Water (Prevention & control of Pollution) Act, 1974 and under Air (Prevention & control of Pollution) Act, 1981 may be granted upto 30.09.2028 with subject to suitable conditions and special conditions that: - 1. The industry will only start its operation after ensuring compliance of the standard operating procedures prescribed for such units by the Board. 2. The industry shall maintain the record of consumption of fresh water on daily basis. 3. The industry shall install sludge thickener for recycling of washing effluent within 6 months. 4. The industry shall continue operating the water sprinkler system to suppress the dust emission. 5. The industry shall submit ambient air quality monitoring report from the Boards lab/ approved Boards lab within a period of three months. 6. The industry shall not take participate in any illegal mining activity and shall not procure raw material from any illegal mines. 7. The industry shall comply with the provisions of the Punjab Minor Mineral Concession Rules or any other rules framed there under the Mines and Mineral (Development & Regulation) Act, 1957. 8. The industry shall bound to comply with the bye laws of Master Plan of the area notified by the Deptt. of Town & Country Planning, Punjab. 9. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments. 10. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 11. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received. 12. The Consent is being issued to the industry based upon the documents/ information submitted by it alongwith the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 13. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry. *Competency –Environmental Engineer Date of Receipt : 24.02.2024 Date of Scrutiny : 03.03.2024 Date of Deemed Approval : 19.03.2024
