File Note: Sir, the industry is a small scale orange category unit and was earlier granted consent under Water Act, 1974 & under Air Act, 1981 both valid upto 30/09/2025. The industry is a barreling unit located in close proximity to the gas leak site. This is one of the violating units found in Giaspura gas leak case. The board has issued directions u/s 33-A of Water Act, 1974 was issued for closure of the industry, imposed EC of Rs. 1.5 lakh, also decided to prosecute under the relevant provisions of law. Accordingly, the electric connection of the industry was got disconnected from PSPCL officials on 17.05.2022 for which separate e-noting was moved. Now, the industry has applied for consent to operate with the request regarding restoration of electric connection. The industry has submitted Rs. 25000/- as first installment of EC of Rs. 1.50 Lacs imposed on the industry. RO reported that the industry has submitted a written request that the rest of the amount of EC may be taken in 5 equal installments as it is not in a financial position to deposit full amount of EC immediately. The industry has also submitted in the written request that it has removed the entire barreling machinery also. The industry has submitted in writing that it is facing severe financial crunch due to the non-operation of the industry since last one year. It is further informed that the industry was only a caustic barreling unit and no acid was used in the process. RO further reported that the industry was earlier visited on 12.07.2023 and it was observed that the industry was lying closed due to disconnection of electric supply. The industry has removed the entire barreling machinery and only dry machinery is now lying in the industrial premises. The industry was again visited on 17.11.2023 and it was observed that the barreling machinery has been removed and only dry machinery is now lying in the industrial premises. The industry was again visited on 27.02.2024 and it was observed that the industry was lying disconnected and not in operation. The Criminal prosecution under the provisions of Water Act, 1974 has been filed against the industry in the court of CJM, Ludhiana. In view of report of RO, it is recommended as under: 1. Consent under Air Act, 1981 may be granted to the industry for six months with suitable conditions and special condition that the industry shall submit EC of remaining amount of Rs. 25000/- in five installments within six months as proposed by RO. 2. Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 may be issued for restoration of electric connection of the industry temporarily for six months as proposed by RO, please.
