File Note: It is submitted that the industry is a shoe assembly unit and has established its unit without obtaining prior consent to establish (NOC) and was operating the same without obtaining consent to operate of the Board u/s 25/26 of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981. The industry was visited during the surprise visit to the area by the officers of the Board on 17.10.2023. During visit, it was observed as under: 1. The industry is engaged in assembly of woodland shoes and sandles. 2. The industry has installed 2 no. assembly lines using various machines such as punching machine, drier machine and buffing machine etc. 3. The industry uses different kind of chemical / adhesive for pasting purpose. 4. The empty containers of chemicals / adhesive were found stored in open area and no record has been produced regarding disposal of the same. 5. The industry has not provided any treatment facility for its domestic wastewater. 6. One borewell is found in open condition near toilets, which may use for discharge of surface run off and domestic effluent. 7. Stagnation of wastewater was also observed outside the industrial premises. Accordingly, industry was issued show cause notice for violations under the provisions of the Water Act, 1974 vide Board's letter no. 9087-88 dated 29.11.2023 with an opportunity of personal hearing before the Chief Environmental Engineer, Patiala on 07.12.2023. After hearing, it was decided that: 1. The industry shall apply for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981, within 15 days. 2. The industry shall install / operate its STP regularly & efficiently to achieve prescribed standards. 3. The industry shall not discharge any treated / untreated wastewater into unauthorized mode and entire treated wastewater being utilized onto land for plantation. 4. Environmental Engineer, Regional Office, Patiala shall visit the industry, verify the decisions of the personal hearing and other compliances and submit its report, within one month. 5. Further action shall be taken after the report from the Regional Office, Patiala. The proceedings of the hearing were conveyed to the industry vide Board's letter no. 9904-05 dated 03/01/2024. Now, in compliance of the decisions of the personal hearing, the establishment has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 in the name and style of M/s Aero Club bearing khasra no. 1116/609, 1118/610/2 (1.1766 acres) in the revenue estate of Banur Tepla Highway Vill Kheri Gurna Opp Chandigarh Floor Mill, Tepla, Tehsil Rajpura, Distt. Patiala for manufacturing of Shoes @ Nos./day by using Shoe Sole @ 1500 Nos./day, Shoe leather upper @ 1500 Nos./day, Adhesive @ 0.6 ltr/day, Dunlop @ 0.6 ltr/day, Rubber Cleaner @ 0.6 ltr/day, Tolvin @ 0.6 ltr/day and Latex @ 0.6 ltr/day for discharging of domestic effluent @ 1.5 KL/day under green category along with requisite documents i.e. partnership deed, lease deed (from 01.04.2021 to 01.11.2026), CA certificate, electricity bills, CLU etc. The industry has taken the godown on lease from Sh, Vinay Mahajan having area of 26500 sqft w.e.f 12/03/2021. Accordingly the industry has submitted a revenue report from revenue estate of Tehsil Rajpura dated 24.01.2024 (copy attached) The industry has submitted a copy of CLU obtained from Deptt. of Town and Country, Planning, Punjab for Godown ( Agriculture Produce) / Cold Store purpose has been considered in this office vide memo no. 862 dated 20.03.2020 (copy attached): Hence, the site is suitable for the establishment of the proposed unit as per the general siting guidelines prescribed by the Board. The establishment has submitted approved building from Competent Person from Deptt. of Town and Country, Planning, Punjab. The establishment has submitted electricity bill as its proof, mentioning date of connection as 02/06/2021. The establishment has deposited Rs. 24200/- vide online receipt no. 31200767 dated 30.11.2023 & Rs. 24000/- vide online receipt no. 422181374 dated 22.02.2024 as water consent fee and Rs. 26900/- vide online receipt no. 627384633 dated 30.11.2023, Rs. 2200/- vide UTR No. 388532117 dated 31.01.2024 & Rs. 70400/- vide online receipt no. 155974829 dated 22.02.2024 as air consent fee against the fixed assets of Rs. 104.00 lakh as on 05.02.2024 as per CA certificate dated 06.02.2024 submitted by the industry, which is adequate upto 31.03.2029 after deducting penalty fee of Rs. 38400/- and NOC regularization of Rs. 6400/-. The industry was visited by the AEE of this office on 01.03.2024 to verify the contents of the application and it was observed that: 1. The industry is engaged in assembly of woodland shoes and sandles. 2. The industry has installed 2 no. assembly lines using various machines such as punching machine, drier machine and buffing machine etc. 3. The industry uses different kind of chemical / adhesive for pasting purpose. 4. The empty containers of chemicals / adhesive were found stored in a closed room. The representative of the establishment was asked to maintain the record of the same and also to apply immediately for authorization under HWM Rules, 2016. 5. The industry has provided STP for treatment of its domestic wastewater. The representative of the industry informed that the same is being operated after failing of the collection tank only. 6. During visit, effluent samples could not be taken due to non-availability of effluent at the outlet of STP. 7. The establishment has provided small plantation area for treatment of domestic effluent. Therefore, the establishment was advised to provide permanent plantation along the complete boundary wall of the premises. 8. The establishment has also not provided water meter on the inlet and outlet of the STP. 9. The establishment has provided stacks with DG sets of capacity 200 KVA and 30 KVA. Therefore, the establishment is partially complying with the decisions of personal hearing as well as provisions of the Water Act, 1974 and the Air Act, 1981. In view of the above, may if approved, recommendations be sent to SEE, ZO-1, Patiala that: 1. Notice to issue directions u/s 33-A of the Water Act, 1974 may be dropped please. 2. Fresh consent to operate under the Air Act, 1981 under green category may be granted to the industry upto 31.10.2026 (upto the validity of lease agreement) subject to the suitable conditions as per the policy of the Board. 3. Fresh consent to operate under the Water Act, 1974 under green category may be granted to the industry for a shorter period of six months upto 30.09.2024 subject to the suitable conditions and special conditions as under: a. The establishment shall provided water meter on the source of fresh water, inlet and outlet of STP and shall maintain the record of the same properly, within one month. b. The establishment shall provide adequate plantation area within the premises for utilization of treated wastewater within one month. c. The establishment operate its STP plant regularly and efficiently at all the times. d. The establishment shall get its effluent sample analyzed from Board's laboratory within one month. e. The establishment shall apply for obtaining authorization under HWM Rules, 2016.
