File Note:  The industry was granted consent to establish under Water Act, 1974 and Air Act, 1981 vide no. CTE/Fresh/MNS/2023/20564098 dated 16.01.2023 valid upto 15.01.2024 for establishing mix board mill with production capacity @ Card Board/Mix Board @ 8 TPD by using raw material as Primary ETP sludge of pulp & paper mill @ 5 TPD, Paddy Straw @ 3.25 TPD, Jute Bags/Cow Dung @ 3.25 TPD, subject to the suitable conditions and special conditions : - 1. The consent to establish is granted to the industry for its establishment in an area of 08 Kanal 18 Marlas bearing khasra no. 195//23/3/1 (1-4), 24/1(4-0) & 25/1 (3-14) in the revenue estate of village Bahadurpur, Tehsil Bareta. Distt. Mansa. 2. The industry shall comply with Standard Operating Procedures framed by CPCB for utilization of primary ETP sludge of pulp & paper mill (category 32.3 of schedule-I) of HOWM Rules, 2016. 3. The industry shall ensure the compliance of zoning regulations of the Master Plan to be notified by the Department of Town & Country Planning, Punjab. 4. This 'Consent to Establish' (NOC) is issued from pollution angle and the industry shall obtain the statutory clearances/permissions from the other concerned departments, as required.  Now, the industry has applied for obtaining fresh consent to operate under the Water Act, 1974 & the Air Act, 1981 through OCMMS for operation mix board mill with production capacity @ Card Board/Mix Board @ 8 TPD by using raw material as Primary ETP sludge of pulp & paper mill @ 5 TPD, Paddy Straw @ 3.25 TPD, Jute Bags/Cow Dung @ 3.25 TPD with requisite doucments.  The industry has deposited fees under Air Act, 1981 and Water Act, 1974 @ Rs. 7200/- vide 381159929 & 814373390 dated 01.02.2024 which is adequate upto 30.09.2024 against the fixed assets of Rs. 81.51 lacs as per CA certificate dated 16.01.2024.  The industry has attached compliance of NOC conditions, site plan, manufacturing process, agreement with paper industry and electricity bill.  The industry was visited by officer of this office on 04.03.2024 and was found as under: - i. The industry was in operation during visit and also utilising paper industry sludge without obtaining HWM authorisation/passbook for its utilisation. The industry has installed 2 no. Cardboard rolling machines that are in operation. ii. The industry has made arrangement for recirculation of waste water generated from the process and to reuse the same back into process after collecting it in collection tank. However it has not installed the flow meters. iii. The industry has constructed septic tank for the treatment of domestic effluent however has not developed plantation inside the premises along the boundary wall. iv. The industry has made proper arrangement for storage of paper mill sludge and has constructed shed of dimensions 60 ft X 60 ft with brick cement mortar flooring whereas during visit the sludge was also observed to be unloaded adjoining to the impervious flooring outside the shed. v. The industry has provided boundary wall all along the premises. vi. There is no source of air pollution in the industry. In view of above, it is clear that the industry is not complying with the conditions of consent to establish under the provisions of Water Act, 1974 and Air Act, 1981 granted to it. Further, The industry is also not complying with guidelines of SoP for use of paper mill sludge. Recommendations:  It is recommended that fresh consent to operate under the Water Act, 1974 and Air Act, 1981 applied by the industry may be refused after affording an opportunity of personal hearing please.
