It is submitted that earlier, consents to operate were granted to the industry on the name & style of firm M/s M.C. Traders under the provisions of the Water Act, 1974 and Air Act, 1981 vide nos. CTOW/Fresh/MOG/2018/7877519 and CTOA/Fresh/MOG/2018/7877505 dated 13.07.2018, respectively, for production of Pasteurized Milk, Ghee, Butter, Cream/ Milk concentrate @ 50000 Ltrs/day by processing raw milk @ 50000 Ltrs/day along with discharge of treated trade effluent @ 90 KLD onto land for plantation as per Karnal Technology after treatment through ETP, which had been expired on 30.06.2023, subject to the suitable conditions alongwith specific conditions mentioned therein.
Thereafter, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 & the Air Act, 1981 though OCMMS on 02.02.2024 on its new name & style M/s M. C. Foods and Nutrition, for enhance the production capacity of Pouched Milk @ 50000 ltrs/day, Ghee @ 5000 kgs/day, Lassi @ 5000 ltrs/day, SMP @ 10 MTD, Paneer @ 500 kgs/day, Curd @ 25 MTD by processing raw milk @ 160 KLD and upgraded of existing ETP to enhanced the treatment capacity from 90 KLD to 200 KLD. The case had been scrutinized and found that the industry has increased its premises from 4 kanal to 5 marla to 39 kanals 17 marlas, but not submitted the suitability of additional land area. Moreover, the industry has not submitted adequate land area under plantation for discharge of treated trade effluent @ 126 KLD + domestic effluent @ 5 KLD. Accordingly, the application was returned with advice to resubmit with suitability reports of additional land of concerned authorities and submit the adequate pollution control measures.
The industry was visited by undersigned (AEE) on 08.02.2024 and effluent samples from outlet of upgraded ETP were collected and as per results, the concentration of pH, TSS, COD, BOD, Oil & Grease was found 8.4, 88 mg/l, 222 mg/l, 48 mg/l, 6.8 mg/l, which is within prescribed limit for such discharge onto land plantation area.
The industry has submitted a request in this office for taking the comments from DTP, Moga and SDM, Nihal Singh Wala for suitability of site after addition of land, thus making total land area of 39 kanals 17 marlas as single site with revenue record of total area. Accordingly, this office has requested to DTP, Moga and SDM, Nihal Singh Wala vide this office letter no. 815 dated 15.02.2024 and 817 date dated 15.02.2024, respectively for comments on suitability of site.
Accordingly, the DTP Moga vide its letter no. 165 dated 19.02.2024 has submitted its report, the relevant part of which is reproduced as under:
"ਵਾਧੇ ਅਧੀਨ ਪੈਂਦੇ ਰਕਬੇ ਵਿੱਚੋ ਕੁੱਝ ਹਿੱਸਾ ਮੌਕੇ ਤੇ ਖਾਲੀ ਅਤੇ ਕੁੱਝ ਹਿੱਸੇ ਵਿੱਚ ਮੌਕੇ ਤੇ ਉਸਾਰੀ ਕੀਤੀ ਹੋਈ ਹੈ। ਸਾਈਟ ਨੋਟੀਫਾਈਡ ਲੋਕਲ ਪਲੈਨਿੰਗ ਏਰੀਆ ਨਿਹਾਲ ਸਿੰਘ ਵਾਲਾ ਅਤੇ ਬੱਧਨੀ ਕਲਾਂ ਦੀ ਹਦੂਦ ਅੰਦਰ ਪੈਂਦੀ ਹੈ, ਜਿਸਦਾ ਮਾਸਟਰ ਪਲੈਨ ਹਾਲ ਦੀ ਘੜੀ ਤਿਆਰ ਨਹੀ ਹੈ। ਭਾਵ ਇਸ ਜਗ੍ਹਾ ਦਾ ਹਾਲ ਦੀ ਘੜੀ ਕੋਈ ਜ਼ੋਨ ਨਿਰਧਾਰਤ ਨਹੀ ਹੈ। ਸਾਈਟ ਵਿੱਚ ਮਿਲਕ ਪ੍ਰੋਸੈਸਿੰਗ ਯੁਨਿਟ (ਰੈਡ ਕੈਟਾਗਿਰੀ) ਆਗਿਆਯੋਗ ਹੈ। "
The SDM Nihal Singh Wala vide its letter no. 97 dated 27.02.2024 submitted its report, relevant part of which is reproduced as under:
"ਮੈਸ: ਐਮ.ਸੀ. ਟਰੇਡਰਜ਼ ਬਾਘਾ ਪੁਰਾਣਾ ਰੋਡ, ਨਿਹਾਲ ਸਿੰਘ ਵਾਲਾ ਵਾਕਿਆ ਰਕਬਾ ਰਣਸੀਹ ਖੁਰਦ ਰਕਬਾ 39 ਕਨਾਲ 17 ਮਰਲੇ ਦੇ 100 ਮੀਟਰ ਦੇ ਘੇਰੇ ਵਿੱਚ ਕੋਈ ਨਗਰ ਪੰਚਾਇਤ, ਪਿੰਡ ਦੀ ਫਿਰਨੀ / ਲਾਲ ਲਕੀਰ ਕੋਈ ਵਿਦਿਅਕ ਅਦਾਰਾ, ਰਿਹਾਇਸ਼ੀ ਕਲੌਨੀ ਜਾਂ ਪੱਕੇ ਮਕਾਨ ਨਹੀ ਹਨ। "
Now, the industry has again applied for obtaining fresh consents to operate under the Water Act, 1974 & the Air Act, 1981 though OCMMS on 28.02.2024 on its new name & style M/s M. C. Foods and Nutrition, for enhance the production capacity of Pouched Milk @ 50000 ltrs/day, Ghee @ 5000 kgs/day, Lassi @ 5000 ltrs/day, SMP @ 10 MTD, Paneer @ 500 kgs/day, Curd @ 25 MTD by processing raw milk @ 160 KLD and upgraded of existing ETP to enhanced the treatment capacity from 90 KLD to 200 KLD, details of case is as under:
1. The industry has submitted copy of CA certificate dated 19.01.2024, showing gross fixed assets of Rs. 1988.15 lakhs (including value of plant & machinery @ 1428.12 lakhs) as on 31.12.2023. As such, the industry falls under large scale red category industry as per prevailing policy of the Board.
2. The industry has deposited consent fee of Rs. 335000/- vide UTR / Ref. No. PSIBR52023062600540223 dated 26.06.2023 under the Water Act, 1974 and Rs. 335000/- vide UTR / Ref. No. PSIBR52023062600540172 dated 26.06.2023 under the Air Act, 1981, which are adequate upto 30.06.2030 after adjusting penalty under both the Acts. The industry has also deposited NOC regularization fee of Rs. 42000/- vide UTR / Ref. No. SDL133414384 dated 26.06.2023, for increase in value of fixed assets in its existing premises, which is adequate.
3. The industry has submitted copy of revenue record.
4. The industry has submitted copy of approved building plan vide no. DOF221041168, File no. 210633621, dated 04.10.2022 duly signed by Er. Rishi Garg, Competent Person approved under Punjab Factory Act.
5. The industry has submitted copy of completion certificate regarding upgradation of ETP and now the industry has provided ETP of 200 KLD capacity (MBBR technology) consisting of Equalization tank, Oil & Grease Trap, Anaerobic Bio-filter tank, Aeration tank-I, Clarifier-I, Aeration tank-II, Clarifier-II, Intermediate Storage Tank, Multi-Grade media filter & Sludge Drying beds.
6. The industry has submitted copy of manufacturing process chart.
7. The industry has submitted copy of undertaking stating as under:
"ਮੈਂ ਆਪਣੇ ਪਲਾਂਟ ਵਿੱਚੋਂ ਨਿਕਲਣ ਵਾਲੇ ਪਾਣੀ ਨੂੰ ਪੰਜਾਬ ਪ੍ਰਦੂਸ਼ਣ ਕੰਟਰੋਲ ਬੋਰਡ ਦੀ ਨਿਯਮਾਂ ਮੁਤਾਬਿਕ ਡਿਸਚਾਰਜ ਕਰਨ ਦੇ ਲਈ ਕੁੱਲ 32 ਕਨਾਲ 16 ਮਰਲੇ, 17 ਕਨਾਲ ਖਸਰਾ ਨੰ: 1114//10(8—0), 11(8—0), 20/1(1—0)ਕੁੱਲ 16 ਕਨਾਲ 16 ਮਰਲੇ ਜੋ ਕਿ ਅਸੀ ਪਟੇਨਾਮਾ ਤੇ ਲਈ ਹੈ, ਜਿਸ ਦੀ ਪਟੇਨਾਮਾ ਦੀ ਕਾਪੀ ਨਾਲ ਨੱਥੀ ਹੈ ਅਤੇ 16 ਕਨਾਲ ਰਕਬਾ ਜਿਸਦੀ ਰਜਿਸਟਰੀ ਨਾਲ ਨੱਥੀ ਹੈ ਜੋ ਕਿ ਸਾਡੇ ਆਪਣੇ ਫਰਮਾਂ ਦੇ ਨਾਮ ਉਪਰ ਹਨ, ਜਿਸ ਦੇ ਅਸੀ/ ਮੈਂ ਮਾਲਕ ਹਾਂ ਵਿੱਚ ਹੀ ਕਰਾਂਗੇ।"

8. The industry has submitted copy of effluent sample report dated 15.12.2023 issued by Centre for Environment and Food Technology Pvt. Ltd. and as per which sample were collected on 09.12.2023 from outlet of the ETP, results of various parameters are pH=7.51, TSS=89mg/l, TDS=1284mg/l, BOD=92mg/l, COD=342mg/l, Oil&Grease=5.4mg/l, which found within the prescribed limit.
The industry was visited on 05.03.2024 by the AEE and following observations were made:
1. The industry has expanded its premises now the industry in an area 39 kanal 17 marlas, for which the industry has submitted comments from concerned departments i.e. DTP and SDM for its suitability. The total site is located along Nihal Singh Wala – Baghapurana road. There is no Village phirni, residential area (cluster of 15 houses), educational institute falls within the 100 meters of the industry premises. As such, the site is suitable for regularization of expansion of the industry.
2. The industry was in operation on its full capacity for processing of milk.
3. The upgraded ETP, consisting of Equalization tank, Oil & Grease Trap, Anaerobic Bio-filter tank, Aeration tank-I, Clarifier-I, Aeration tank-II, Clarifier-II, Intermediate Storage Tank, Multi-Grade media filter & Sludge Drying beds was in operation for treatment of waste water arising from processing of milk.
4. The treated effluent was being discharged onto land for plantation developed in 4 acres land at about 300 meters distance from the ETP through underground pipeline, the condition of the plantation area was found good. The plantation area is adequate to discharge @ 131 KLD. Earlier, this plantation area was common with the sister concerned unit namely M/s Shankar Rice & General Mills (saila plant), but now M/s Shankar Rice & General Mills has obtained CTO of the Board under Water Act, 1974 and Air Act, 1981 for production of steamed rice.
5. The industry has provided flow meter at the outlet of ETP and water sources, energy meter with ETP. The record of the same is being maintained.
6. The industry has installed new boiler of capacity 8 TPH during 2023 by removing its existing 02 no. boiler of capacity 900 kg/hour each. The industry has installed twin cyclone as APCD with the boiler to contain the emission, same was in operation. The industry is using rice husk @ 15 TPD as fuel in the boiler. The Board officer of the Board has already collected emission sample of this boiler on 26.05.2023 and as per analysis results, the concentration of the SPM was found 187 mg/Nm3 against the 1000 mg/Nm3, which is within the prescribed limit for such discharge.
7. The industry is disposing its fuel ash on 2 acres land on the ownership of its sister concerned unit M/s Shankar Rice & General Mills, which is low lying area and located at about 6 km from the industry site. The industry is transporting the fuel ash through covered tractor trolley.
8. The industry is complying with the provisions of the Water Act, 1974 and the Air Act, 1981.
The industry has adopted adequate measures for control of pollution generated through during the processing of milk and site is suitable for regularization of expansion of the industry as per the prevailing policy of the Board.
After the expansion, the industry falls under the large-scale red-category, as such the competency for deciding the case is lying with Hon’ble Chairman of the Board.
In view of the above, it is recommended that fresh consents to operate under the Water Act, 1974 and Air Act, 1981 may be granted to the industry on its new name & style M/s M. C. Foods and Nutrition, for enhance the production capacity of Pouched Milk @ 50000 ltrs/day, Ghee @ 5000 kgs/day, Lassi @ 5000 ltrs/day, SMP @ 10 MTD, Paneer @ 500 kgs/day, Curd @ 25 MTD by processing raw milk @ 160 KLD with discharging of effluent @ 131 KLD (trade = 126 KLD and domestic = 5 KLD), for a period upto 31.03.2029 each, subject to the suitable conditions.
