Sir, the industry was issued show cause notice for refusal of 'Consent to Operate' under the Water Act, 1974 with opportunity of personal hearing before the CEE, Ludhiana on 23.01.2024 w.r.t, wherein, it was decided as under:-
1. The industry shall operate ETP and APCD regularly and efficiently, so as to achieve prescribed standards at all times.
2. The industry shall maintain the record of water consumption, chemical used for treatment of effluent and discharge.
3. The industry shall ensure that there is no stagnation in plantation area in future.
4. The industry shall store hazardous waste of all categories in scientific manner.
5. The industry shall apply for varied consent to operate under the Air (Prevention & Control of Pollution) Act, 1981 for new paddy based boiler, within 07 days.
6. The Environmental Engineer, Regional office-1, Ludhiana shall visit the industry, verify submission made by industry, collect effluent/ emission samples and submit report alongwith recommendations, within 15 days.
To check the compliance, the industry was visited by RO on 23.01.2024, and it was reported as under:-
1. The industry has provision of plantation area of 5 Acre. Out of which, plantation area of only 2.5 acre has been provided by the industry. Hence, the industry has failed to develop adequate plantation area for disposal of treated effluent.
RO recommended that 'Consent to Operate' under Water Act, 1974 may be renewed for shorter period of six months with special condition that the industry shall develop proper plantation under Karnal Technology in an area of 2.5 acres within one month, which is currently under restoration.
To discuss the progress of completion of plantation area, another opportunity of hearing has been approved by Competent Authority. However, notice could not be issued due to want of date of hearing.
If approved, 'Consent to Operate' under Water (Prevention & Control of Pollution) Act, 1974 may be granted to industry for shorter period of six months with special condition, as proposed by RO, please. (Category -Red, medium) (Competency -CEE )
This case is pending since 06.12.2023 and pendency will be discussed in the meeting to be taken by Hon'ble Secretary on 19.03.2024.
