It is submitted that the unit has applied for obtaining Consent to Operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, under Orange Category through OCMMS with required documents for operating of Hotel Rooms @ 40 Nos/day, D.G. Sets of capacity 200 KVA, 125 KVA and Domestic effluent @ 11.7 KLD with mode of disposal Into Sewer through septic tank under VDS i.e. Voluntarily Disclosure Scheme.
The industry has deposited VDS fee of Rs. 10,000/- vide UTR No. 000144572419 dated 13/02/2024 under Air (Prevention & Control of Pollution) Act, 1981 and also deposited Rs. 10,000/- vide UTR No. 000144572337 dated 13/02/2024 under Water (Prevention & Control of Pollution) Act, 1974.
The unit has deposited Rs. 1,06,400/- (Rs. 34,200/- vide UTR No. 000144572069 dated 13/02/2024 & Rs. 72,200/- vide UTR No. 0001451318365 dated 29/02/2024) as consent to operate under Air (Prevention & Control of Pollution) Act, 1981 and Rs. 1,06,400/- (Rs. 34,200/- vide UTR No. 000144572121 dated 13/02/2024 & Rs. 72,200/- vide UTR No. 0001451317795 dated 29/02/2024) as consent to operate under Water (Prevention & Control of Pollution) Act, 1974, which is adequate up to 30/09/2029 under both Acts. The unit has also deposited Rs. 500/- vide UTR No. 000144572517 dated 13/02/2024 as an application form fee.
The unit has submitted Registered Deed, Partnership Deed, latest CA Certificate, proof of date of commissioning, Site Plan/Location Plan, Approved Building Plan from MC, Amritsar etc.
As per the categorization of CPCB, the industry falls under list of orange category industries, “Hotels (< 3 star) or hotels having > 20 rooms and less than 100 rooms or having waste water generation > 10 KLD and less than 100 KLD and having a coal/Oil fired Boiler” at serial no. 2038.
It is pertinent to mention here that earlier the Board has issued order vide no. CEE(HQ)F.No. 957/2016/59 dated 2/2/2016 regarding to grant of auto renewal consent to establish/consent to operate to the Orange & Green category industries. Now in continuation to above orders Board has issued fresh orders vide no. 329 dated 14/9/2023 regarding to Auto generation of renewal of consent to establish / operate / Authorization of any category of Small-Scale industries / projects / Health Care Facilities (up to 50 beds) and Hazardous Waste generating industries.
It is further submitted that the unit falls in Orange category in Small Scale sector and competency to decide the case lies with the Senior Environmental Engineer of the Board.
In view of the above, may if approved, the consent to operate under the provisions of Air (Prevention & Control of Pollution) Act, 1981 & Water (Prevention & Control of Pollution) Act, 1974 may be granted to the unit under Orange Category up to 30/09/2028 with usual terms and conditions along with following special conditions:-
1. The unit will comply with the conditions of consents granted to it.
2. The unit at any stage will not generate any emission and trade effluent from its premises. |
