It is submitted that the PP has applied for setting up a SCO and booth namely M/s Time Square developed by Metro Developers and Builders for SCO @ 363 no. (capacity 6 Persons x 363 = 2178 persons) and booth @ 22 no. (capacity 2 Persons x 22 = 44 persons) in an total area of project 141 kanal 19 marla (85879.75 sqm) in the revenue estates of Village Deogarh, Patran-Jakhal Road, Tehsil Patran, Distt. Patiala. The PP has submitted copy of ADC(UD), land documents, feasibility report, project report-cum-feasibility report, sewer bill, partnership deed, copy of Jamabandi etc. along with the application form.
The project proponent has been granted ADC(UD) vide letter Memo No. ADC(UD)/EO/2024/258 Date 23-09-2021 from the O/o Additional Deputy Commissioner (Urban Development), Patiala issued of letter of intent for setting up a commercial project under 11 (3) of PAPRA Rules, 1995 (copy attached).
The industry will require water for domestic purpose @ 100 KLD water, which contributes to about 80 KLD will be discharged into M.C. sewer issued by Municipal Council, Patran vide letter no. 1454 dated 11.11.2022.
The industry has deposited Rs. 18500/- (18000/- NOC fee and Rs. 500/- as application form fee) vide UTR. No. IDIBH24053214927 dated 22.02.2024 on account of NOC fee against the proposed project cost of Rs. 9.46 Cr. as per the project report, which is adequate for one year.
The project proponent has proposed to STP for consisting of Collection Tank MBBR reactors Tube settler Clear water sump Sludge drying beds for discharge of domestic effluent of capacity 80 KLD into Sewer after treatment through STP.
Accordingly, the proposed site was visited by undersigned on 07.03.2024 and observed as under:
1. The PP has started constructions of boundary wall and excavation work has been started.
2. The PP has submitted CLU from ADC (UD), Patiala without date.
3. No air polluting industry was observed within the 100m from the proposed site.
4. No MAH unit exist within the 250 mtr from the site.
5. The project proponent has now change the proposal of domestic effluent discharge, which is not acceptable. As per recent Board’s office order, only domestic effluent will be discharged into plantation area / green area and surplus will be allowed to discharged into sewer. However, condition may be imposed that more than 50% discharge will be done on plantation area / green area and decided plantation area may be provided.
6. The project proponent has informed that they will sale only plots and applied under the wrong category building and construction project. The project proponent needs to apply under the area development project.
7. The plots shown in the map are adjacent and project proponent must give sale deed of all the plots at the time of consent to operate and ensure that it will sale only plot not shops / booths constructed, otherwise it will cover under EIA notification dated 14.09.2006.
8. The total saleable area is more than 20000 sqm, if the project proponent shall not construct its own shops / booths, otherwise it will cover under Environment Clearance.
In view of the above, if approved, the Project Proponent may be recommended that consent to establish (NOC) from pollution angle for SCO @ 363 no. (capacity 6 Persons x 363 = 2178 persons) and booth @ 22 no. (capacity 2 Persons x 22 = 44 persons) in an total area of project 141 kanal 19 marla (85879.75 sqm) under orange category as area development project subject to the suitable conditions and following additional conditions:-
a. The project proponent must give sale deeds of all the plots at the time of consent to operate and ensure that it will sale only plot not shops / booths constructed, otherwise it will cover under EIA notification dated 14.09.2006.
b. The NOC / consent to operate shall be revoked, if the project proponent found constructing its own booths / shops.
c. The project proponent shall not commission its unit without obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981.
d. The project proponent shall provide dedicated area for handling the discharge of treated waste water and ensure that more than 50% of discharge will be handed in green area/ plantation area and only surplus will be discharged into the MC sewer.
e. The project proponent shall comply with the provisions of the Solid Waste Management Rules, 2016 for disposal of solid waste generated from the premises.
f. The project proponent shall install mechanical composter for handling the Solid Waste before commissioning of the project.
g. The project proponent shall comply with PWRDA guidelines.
h. The project proponent shall comply with the provisions of Noise Pollution (Regulation & Control) Rules, 2000. |
