Subject:- Application for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 - M/s Gunia Brick Kiln Gram Udyog Previously know as GUNIA GRAM UDYOG, Village- Gunnia, P.O. Dhariwal, District-Gurdaspur.
Earlier, the consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 vide online reference no. CTOW/Fresh/GRP/2024/24537705 & no. CTOA/Fresh/GRP/2024/24537694 dated 09/01/2024 which are valid upto 30/09/2027 under Orange Category under name and style Gunia Gram Udyog.
Now, the brick kin has applied for obtaining fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 under new name and style from M/s Gunia Gram Udyog to M/s Gunia Brick Kiln Gram Udyog under Orange Category through OCMMS mode along with requisite documents.
The brick kiln has already deposited Rs. 31900/- Vide online UTR No. 000842078793 dated 17/03/2023 and Rs. 41100/- Vide online UTR No. 000842079549 dated 17/03/2023 as consent to operate fee under Air (Prevention & Control of Pollution) Act, 1981 and Water (Prevention & Control of Pollution) Act, 1974, including Rs. 2900/- as NOC regularization fee, penalty fee and Rs. 500/- as application fee which is adequate upto 31/12/2027 against total gross value of fixed assets worth Rs. 49,29,102/- as on 31/01/2023 as per CA certificate submitted by the BKO.
The BKO has already submitted copy of coal register authenticated by CA which shows that the brick kiln was not operation from the period of Feb-2019 to Dec-2020, hence, imposition of Environmental Compensation is not applicable on the brick kiln.
The BKO has already submitted completion certificate issued by PSCST, Chandigarh vide letter no. PSCST/CC/1578 dated 01/12/2020 intimating that the industry has constructed induced draft Brick Kiln with zig-zag firing as per the technology evolved by the Punjab State Council for Science & Technology. The Kiln owner will ensure the implementation of recommended operating practices as per the Feasibility Report (SPL-1348). The Brick Kiln has also submitted the copy of dimensional drawing/plan of Kiln showing the length of Central Island of brick kiln is 216 ft.
The BKO was visited by officer of the Board on 06/03/2024 and observed as under:-
1. The brick kiln was not in operation during the visit.
2. The BKO has constructed its brick kiln into induced Draft Brick Kiln with Zigzag setting having rectangular in shape.
3. The BKO has installed induced draft fan with the stack of the brick kiln.
4. The BKO has stabilized the peripheral road around the kiln trench with brick bats/keri.
5. The BKO has planted trees along the boundary of Brick Kiln. The BKO was advised to plant more trees around the boundary of the kiln.
May if approved, it is recommended that Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to the Brick Kiln for a period upto 30/09/2027 subject to the suitable conditions along with the special conditions as under:-
1. The project proponent shall comply with code of practice/directions issued by PSCST, Chandigarh.
2. The brick kiln will obtain Environmental Clearance under EIA notification for mining of brick clay to be used as a raw material for the manufacturing of bricks as per Head Office order no. 346 dated 1/8/2016.
3. The brick kiln shall get its stack emission analyzed as per policy of the Board.
4. The consent is subject to the orders passed by the Hon’ble High Court for the state of Punjab & Haryana/Hon’ble National Green Tribunal or other judiciary authority in the cases pending or being filed with regard to the subject matter of the office order.
5. The consent is subject to the performance evaluation of new technology adopted by the brick kiln.
6. The brick kiln will plant adequate trees around the boundary of the Brick Kiln.
7. The Brick Kiln shall use atleast 20% Paddy Straw Pellets as fuel with coal as per Board’s notifications no. 10/574/2022-STE1/443 dated 04/11/2022.
