The project proponent has applied for obtaining fresh consent to operate under the Water Act, 1974 and the Air Act, 1981 for operation of multiplex complex consists of cinema hall 4 screens, restaurant with sitting capacity @ 60 person, banquet hall of capacity 100 person, Bar room with sitting capacity @ 40 person and hotel with 16 rooms, under orange category. The project proponent has not obtained NOC / consents of the Board. Details of the case are as under:-
1) The project proponent has submitted change of land use issued by the Senior Town Planner, Punjab Bureau of Investment Promotion for area measuring 2.42 acres i.e. 19 kanal 6 marlas 6 sarsahi, bearing khasra nos. 76//16/2(3-9-2) 24(4-18-3), 25/1(2-10-7), 14/2/2(0-11) 15/1(0-2) 17/1(5-2) 23/2(1-3) 80//4(1-10-3) in village Malwal, District Ferozepur.
2) The project proponent has submitted registered sale deed of land through its director.
3) The project proponent has submitted copy of Memorandum of Association under the Companies Act, 1956.
4) The project proponent has submitted copy of electricity bill as proof of its date commissioning, wherein it is mentioned date of connection as 28.02.2016. The project proponent has submitted undertaking through its director mentioning it was not operating during the pandemic COVID-19 period i.e. 01.04.2020 to 31.03.2021 as per instructions of Govt. However, it has not submitted any concrete proof regarding this claim.
5) The project proponent has submitted certificate from CA regarding the fixed assets. As per which, it has total gross fixed assets of Rs. 998.71 lakhs as on 31.03.2023 and Rs. 1987.02 Lakhs as on 31.01.2024. As per CA certificate, the increase of Rs. 988.31 Lakhs in the building, plant & machinery and furniture head. The project proponent has deposited Rs. 3,10,750/- (Rs. 65750/- vide UTR no. 35375646071DC dated 20.02.2024 & Rs. 2,45,000/- vide UTR no. 35135706751DC dated 29.01.2024) under the Water Act, 1974 and Rs. 3,10,750/- (Rs. 65750/- vide UTR no. 35375422381DC dated 20.02.2024 & Rs. 2,45,000/- vide UTR no. ICICR42024012900560378 dated 29.01.2024 under the Air Act, 1981. The project proponent has not deposited NOC Regularization fee.
6) The project proponent has not submitted clear copy of site plan showing total area as wall as area under plantation.
7) The project proponent has submitted completion of effluent treatment plant consisting of Screen Chamber, Equalization Tank, MBBR Bio chip Reactor, Secondary Tube Settler, Storage Tank & Pressure Sand Filter. However, it has not submitted any feasibility report regarding the same.
The site was visited by undersigned (AEE) on 05.03.2024 and it was observed as under:-
1) The site is an multiplex consist of cinema hall 4 screens, restaurant with sitting capacity @ 60 person, banquet hall of capacity 100 person, Bar room with sitting capacity @ 40 person and hotel with 16 rooms.
2) The project proponent has installed ETP with components Screen Chamber, Equalization Tank, MBBR Bio Reactor, Secondary Tube Settler, Storage Tank & Pressure Sand Filter. But, the same was not in operation and the effluent generated is being collected in the collection tank.
3) The project proponent has not developed any plantation area and the effluent after collection in collection tank is being disposed off via mobile tankers into un-earmarked area.
4) The project proponent has not provided any in-situ mechanism for treatment of solid waste and as per representative same is being disposed off to the MC authorities.
5) The project proponent has failed to submit concrete documentary proof regarding date of its commissioning.
6) The project proponent has installed 02 no. DG sets with stack of adequate height and canopy.
The project proponent is not complying with the provisions of the Water Act, 1974 and the Air Act, 1981.
In view of the above, it is recommended that applications for consent to operate under the Water Act, 1974 and the Air Act, 1981 may be refused.
