Note of AEE has been perused.
From the note, it could be made out that the site is meeting with the siting criteria laid down by the Board/Govt. for such type of projects due to reasons as under: -
a) The PP has obtained CLU as well as approved layout plan for development of commercial colony in an area of 141 kanals 19 marlas (85879.75 sq. yard) in M.C. limits of Patran from the Senior Town Planner, Directorate of Local Govt. Punjab vide letter no. C.T.P. (S.S.)-2023/3354 dated 23.11.2023, a copy of which is attached. In this CLU letter, it is specifically mentioned that there the promoter will develop this project as a single unit and is for commercial plotted only.
b) LoI has been issued to the PP to develop commercial colony in an area of 141 kanals 19 marlas (85879.75 sq. yard) by ADC(UD), Patiala vide letter no. ADC(UD)/EO/2024/258 dated 25.01.2024, a copy of which is attached.
c) License to develop the commercial colony has been given by ADC(UD), Patiala vide License No. ADC(UD)/PTL/2024/03 dated 04.03.2024, a copy of which is attached.
d) The site of the commercial colony has been visited by AEE on 07.03.2024 and it was observed that the there is no air polluting industry within 100 meters of the site and no MAH industry within 250 meters of the site. Boundary wall has been constructed and excavation work was under progress.
Regarding apprehensions of AEE about proposal of pollution control measures, it may be noted as under:-
(i) STP of adequate capacity has been proposed and about 1.4 acres green area has been proposed in the approved layout plan, which is adequate for discharge of about 80 KLD discharge of waste water. Although the project has obtained permission from M.C. Patran for discharge of treated sewage from the said commercial colony, but as per the Board’s order no. 315 dated 05.07.2018, in case of commercial colonies within M.C. limits, the treated sewage has to be re-used for flushing purpose/green area and only the excess is to be discharged into M.C. sewer. As the PP has adequate green area for discharge of treated sewage, therefore only excess sewage which cant be taken by the green area shall be allowed to discharge into M.C. sewer.
(ii) The total saleable area of the plots/SCOs is 37291.82 sq. yards i.e. 31,180 sq. meters. However, as per the approved layout plan neither any F.A.R. has been mentioned nor any additional floor plans have been mentioned which means that this is not a building construction project and therefore comes under the definition of area development project having built up area less than 1,50,000 square meters and not covered under EIA notification 14.09.2006 and is not required to obtain EC.
(iii) Dedicated area for solid waste treatment has been proposed by the commercial colony.
Keeping in view of above explanations, it is recommended for grant of CTE to the PP for establishment of commercial colony for the capacity as approved by Directorate of Local Govt. subject to suitable conditions along with following special conditions: -
a. The project proponent will not do construction/construct building on individual plots in the said commercial colony, failing which it will be bound to obtain environmental clearance under EIA notification dated 14.09.2006 and CTE granted shall deemed to be cancelled.
b. The project proponent shall not commission/sale any plot of the commercial colony without obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981.
c. The project proponent shall comply with the provisions of the Solid Waste Management Rules, 2016 for disposal of solid waste generated from the premises.
