The said colony has already been regularized by the Department of Local Government vide letter no. A4-DDLG-2021/25 dated 05.03.2021 and the project proponent submitted a copy of layout plan signed by Executive Officer, Municipal Council, Derabassi. Further, as per letter issued by MC Derabassi vide letter no. 374 dated 14.02.2024, the site of the project is located in residential zone as per the Master Plan. A policy decision is required to be taken at Board level as to whether the siting guidelines laid down by the Government vide notification dated 25.07.2008 as amended on 30.10.2009 are applicable on such projects, which have already been regularized and layout plan have also been approved by the Department of Local Government, or not.
Recommendations:
In view of above, if approved, following actions may be taken:
(1) EE, RO SAS Nagar may be asked to depute concerned AEE to visit the O/o SLO and apprise the whole issue to him and obtain legal opinion in the matter, so that further action can be taken in the matter, please.
(2) The NOC application may be kept pending till the legal opinion of SLO obtains by EE RO.
(3) The matter may be referred to policy cell of the Board for taking a policy decision in the matter at Board level, as to whether the siting guidelines laid down by the Government vide notification dated 25.07.2008 as amended on 30.10.2009 are applicable on such projects, which have already been regularized and layout plan have also been approved by the Department of Local Government, or not.
(4) As the project has already been approved by the Department of Local Government & the site of the project is located in residential zone as per the Master Plan, a temporary relief may be given to common people and amended directions already issued by the Board u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 vide letter no. 10035-39 dated 09.01.2024 for temporarily releasing of electric connection and registry of sale deeds upto 31.03.2024, may be further extended upto 31.12.2024.
