The project proponent has not obtained consent to establish/ NOC of the Board for establishment of the restaurant and has directly applied for fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of restaurant having 26 persons seating capacity along with requisite documents.
The project proponent has submitted brief project report as per which proposed project cost is Rs. 4.97 crore. The project proponent has deposited Rs. 8900/- vide UTR no. 35451308501DC dated 29.02.2024 as NOC fee which is adequate for one year.
The project proponent has submitted Sale deed made on 22.12.2021 between Sh. Narinder Singh Gill and Sh. Manish Aggarwal for plot no. 1266-C, JLPL, Sector 82, SAS Nagar.
The project proponent has submitted Change of Ownership of plot no 1266-C of 1000 sqyd, sector 82, SAS Nagar by JLPL in the name of Sh. Manish Aggarwal vide memo no. 164 dated 10.01.2022.
The project proponent has submitted Memorandum of Association of DSH BLISS ADVENTURES PRIVATE LIMITED.
The project proponent has submitted lease deed made on 22.12.2023 between Sh. Manish Aggarwal and M/s DSH BLISS ADVENTURES Pvt. Ltd., which is valid till 31.01.2034.
The site was visited by the AEE of this office on 11.03.2024 and during visit it was observed as under:
1. The site is situated at Plot no. 1266 sector 82, Mohali for establishment of restaurant operating in the name of “A Fly Dinning Restaurant”.
2. Construction work has been started at the proposed site.
3. The restaurant has proposed DG set of capacity 40 KVA with canopy and adequate stack height.
4. The restaurant has proposed to install Oil & Grease trap for treatment wastewater generated from kitchen during washing of utensils and then discharged into JLPL sewer.
5. The site is suitable for establishment of such type of units.
In view of above, it is recommended that consent to establish under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted for 1 year with suitable conditions as under:
1. The project proponent shall not carry out any activity in its premises, which can change the category of unit from Green to Orange/Red, without prior permission from PPCB.
2. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
3. The project proponent shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received
4. The project proponent shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016.
5. The Consent is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
6. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
7. The project proponent will not carry out any modification/ expansion in the restaurant without obtaining prior permission of the Board.
8. The restaurant shall use of alternatives of single use plastics (SUP) within its premises and will not use any SUP items banned in accordance with MoEF&CC notification no. G.S.R. 571(E) dated 12.08.2021
