It is submitted that the industry was granted consent to establish (NOC) of the Board vide no. CTE/Fresh/PTA/2023/21358277 dated 06/04/2023, valid upto 05/04/2024 for manufacturing of Rice (Saila/Steamed/Dry) @ 4.0 T/Hour by processing of Paddy (For Saila/Steamed/Dry Rice) @ 6.0 T/Hour as raw material and discharge of trade effluent @ 120 KLD, washing of driers/boiler blow down @ 1.0 KLD onto land for plantation after treatment in its ETP and domestic effluent @ 4.5 KLD onto land for plantation after treated in septic tank under red category subject to conditions mentioned therein.
Now, the industry has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 & under the Air (Prevention and Control of Pollution) Act, 1981 for manufacturing of Rice (Steamed/Dry) @ 4.0 T/Hour by Processing of Paddy @ 6.0 T/Hour as raw material and discharge of domestic effluent @ 4.5 KLD onto land for plantation after treated in septic tank and boiler blow down @ 1.0 KLD onto land for plantation under red category along with requisite documents.
The industry has deposited online Rs. 108400/- (Rs. 103000/- as consent fee + Rs. 5400/- as penalty charges) vide Receipt No. 680587989 dated 08.02.2024 under Water (Prevention & Control of Pollution) Act, 1974 and Rs. 110600/- (Rs. 103000/- as consent fee + Rs. 5400/- as penalty charges + Rs. 2200/- as NOC regularization fee) vide Receipt No. 852324809 dated 08.02.2024 under Air (Prevention and Control of Pollution) Act, 1981, which is adequate upto 30.06.2028 against the fixed assets of Rs. 567.69 lakh as per CA certificate as on 31.12.2023 submitted by the industry.
The industry submitted compliance report of Consent to Establish (NOC) conditions earlier granted to it along with other requisite documents.
The industry has also submitted stack emissions sampling reports analyzed by Centre for Environment and Food Technology Pvt. Ltd., Mohali on 05.02.24. As per the report, the concentration of particulate matter is 264 mg/Nm3 (Boiler) and 307 mg/Nm3 (paddy pre-cleaner), which are within the permissible limits as prescribed by the Board.
The industry has submitted completion certificate dated 05.01.2024 in which it was mentioned that the facility was physically inspected and verified, though in inoperative state. The industrial unit has provided two APCDs as under;
a) Paddy milling – cyclonic separator
b) Paddy pre-cleaning – two separate APCDs each based on cyclonic
separator
c) Combustion emissions – multiple cyclonic separators
The air pollution control systems – provided for the process emissions from paddy pre-cleaning and paddy milling processes, and combustion emissions from the boiler furnace – in their present configuration (physical dimensions, specifications, and geometry) along with the associated machinery and equipment provided – conforms to the established design requirements. In their present configurations, the APCDs will perform adequately to achieve applicable statutory standards regarding SPM concentration in the treated emissions., if operated properly.
The industry has submitted approved building plan dated 21.12.2023 from competent person Er. Adarsh Vir Gupta, Patiala.
The industry has submitted letter dated 07.02.2024, which is reproduced as under:
I, Gobind Singla, partner of the firm, submit as follows :-
1. That on dated 06/04/2023 NOC was granted to the unit for processing of Paddy @ 6.0 T/hr. to manufacture Saila/Steamed/Dry Rice @ 4.0 T/hr. and discharge of trade effluent @ 120 KLD, domestic effluent @ 4.5 KLD and any other @ 1 KLD, which is valid up to 05/04/2024.
2. That after obtaining NOC, we have added land measuring 8K-5M in our total land of 52K-11M so as to make it 60K-16M for which Provisional NOC is issued by the DTP, Patiala vide letter no. 2170-DTP(P)/P-62 dated 23/10/2023. Copy of the same enclosed herewith. Further, by addition of land, there is no increase in the production capacity of the unit.
3. That the gross value of fixed assets as on 31/12/2023 is at Rs. 567.69 lacs. (Land- Rs. 94.73 lacs, Building- Rs. 123.29 lacs, Plant & Machinery- Rs. 309.12 lacs and M.F.A- Rs. 40.55 lacs). That at present, the unit has 4 (Four) Driers of 24 MT each, 8 (Eight) Handis of 12 MT each, 6 (Six) Handis of 4 MT each, 1 (One) Sortex, 2 (Two) Silky, 1(One) Petti, 2 (Two) Pneumatic Rulae, 5 (Five) Polisher, 1 (One) Boiler of 8 TPH and 1 (One) D.G. set of 400 KVA.
4. That we are enclosing herewith Approved Building Plan from Competent Person of our unit along with completion certificate of APCD/ETP installed in the unit enclosed herewith.
5. That we are enclosing herewith disposal of boiler’s ash agreement with Sh. Kulwinder Singh S/o Sh. Gurbhej Singh & Sh. Arwinder Singh S/o Sh. Gurbhej Singh, resident of Dera Gobindpura, Village Shutrana, Tehsil Patran, Distt. Patiala.
6. That we have installed ETP in our plant, completion certificate of which is enclosed herewith. However, we have yet to develop required land for plantation so as to dispose the treated wastewater from ETP. As and when the same will be developed, we will intimate your office in this regard. For the time being, we are manufacturing only steamed/dry rice and in future too we will manufacture the same and will not manufacture saila rice until we will completely develop our plantation area as required by your office.
7. That our unit came into production in the month of October, 2023. First sale bill enclosed.
8. That we are depositing online Rs. 2,17,300/- (Air Consent fee : Rs. 1,03,000/- Water Consent fee : Rs. 1,03,000/-, Application Form fee : Rs. 500/- Penalty Charges (Air Consent) : Rs. 5,400/- and Penalty Charges (Water Consent) : Rs. 5,400/- adequate up to 30/06/2028.
The industry has submitted disposal of boiler’s ash agreement
with Sh. Iqbal Singh S/o Sh. Jagjeet Singh, resident of Village Burar, Daftriwala, Tehsil Patran, Distt. Patiala, which is reproduced as under:
I, Gobind Singla S/o Sh. Ram Lal Singla, partner, M/s Swami Food Industries, Village Daftriwala, Patran, Distt. Patiala (Being the First Party) AND
Sh. Iqbal Singh S/o Sh. Jagjeet Singh, Village Burar, Daftriwala, Tehsil, Patran, Distt. Patiala (Being the Second Party)
do hereby solemnly affirm, declare & agree as under :
1. That the 2nd party is the owner of land of more than 1K-11M situated at Village Burar, Tehsil Patran, Distt. Patiala (Copy of Jamabandi attached).
2. That the 2nd party will lift the ash of Husk fired Boiler of the 1st party or the 1st party will itself dispose-off its Boiler’s Ash at the above said site.
3. That the vehicle conveying ash shall be covered from all sides to prevent blowing of ash particles by winds.
4. That the 2nd party will dispose off such ash in a proper manner in their own fields & will cover the ash with soil & sprinkle water on the disposed ash so as to keep it wet.
The industry was visited by officer of the board on 07.03.2024 and contacted Sh. Gobind Singla, partner. During visit, it was observed as under:
i) The industry was in operation.
ii) The industry has installed 4 no. driers of 24 MT each, 8 no. handis of 12 MT each and 6 no. handies of 4 MT each., 1 no. sortex, 2 no. silky, 1 no. petti, 2 no. pneumatic rulae, 5 no. polishers, 1 no.boiler of 8 TPH.
iii) The industry has installed 2 no. cyclone as APCD with the 2 no. paddy pre-cleaner and separate cyclone with the milling section to control process emissions.
iv) The domestic effluent is being discharged onto land for plantation after septic tank.
v) The industry has installed boiler of capacity 8 TPH using rice husk as fuel. The industry has installed multi cyclone as APCD of adequate stack height.
vi) All the dust emitting points have been properly hooded and passed through cyclone as APCD. The pre cleaners are also provided with APCDs i.e. cyclone with stack of adequate height.
vii) The industry installed one no. D.G. set of 400 KVA capacity equipped with canopy and adequate stack height.
viii) The industry has installed two no. submersible pumps and has provided mechanical flow meter on it.
ix) The industry has completed its ETP. However, the same is yet to be in operational mode.
x) The industry has not provided plantation area.
xi) The representative assured that they will not operate saila plant without obtaining consent to operate.
The industry is complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Keeping above in view, it is recommended that fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention and Control of Pollution) Act, 1981 upto 30.06.2028 for manufacturing of Rice (Steamed/Dry) @ 4.0 T/Hour by Processing of Paddy @ 6.0 T/Hour as raw material and discharge of domestic effluent @ 4.5 KLD onto land for plantation after treated in septic tank and boiler blow down @ 1.0 KLD onto land for plantation, under red category under red category, may be granted to the industry, subject to certain condition and following additional conditions that:
1. This consent is valid for manufacturing of Rice (Steamed/Dry) @ 4.0 T/Hour by Processing of Paddy @ 6.0 T/Hour only.
2. The industry shall not manufacture saila rice without obtaining prior written permission from the Board.
3. The industry shall continue to abide by the new code of practice notified by Govt. Notification no. 10/48/2004-STE (4) /932 dated. 15/10/2013.
4. The industry plant shall put in place all the hoods, ductings & enclosures and other components of the APCD at all the times.
5. The industry shall keep the APCD in good running conditions at all the times and shall also operate the same properly and effectively so as to achieve the standards prescribed by the Board.
6. The industry shall dispose of the dust contained by APCD in an environmentally sound manner.
7. The industry shall apply for permission of abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA).
8. The industry will amend its APCD as per amendment (if any) in policy of the Board.
9. The industry shall provide proper and permanent approach to the sample collection facility and the same shall be maintained in proper conditions at all the times.
10. The industry shall comply with the stack emissions standards as laid down by the Board and as amended from time to time by the Board/MoEF and shall be bound to upgrade/replace the APCD to achieve such revised standards.
11. The industry shall discharge only domestic effluent after passing through septic tank.
12. The industry will not generate and discharge any trade effluent. There shall be no stagnation of treated wastewater in the plantation area.
13. The industry shall bound to get its building plan approved afresh from the Director of Factories, Punjab in case there is any change in the building after grant of approval of building plan by the Director of Factories, Punjab and submit the same to the Board.
14. The industry will shift to designated zone within the stipulated time or any amendment in the timeline as per the policy of the Govt.
15. The industry shall inform the Board in writing as and when any change is occurred in the Partnership Deed / Proprietorship / Memorandum of Article of Association, especially with regard to the name and address of the Partner / Proprietor / Director / Subscriber etc, and in any case the industry fails to do so and later on it comes to the notice of the Board that there is any change in Partnership Deed / Proprietorship / Memorandum of Article of Association, action as deem fit under the provision of said Act shall be taken.
