Subject: - Proceedings of the personal hearing given to M/s Jain Mix Board, Gobindpura Road, Village Sangreri Bareta, Tehsil Budhlada, Distt. Mansa before refusal of 'consents to operate' granted under the provisions of the Water Act, 1974 & Air Act, 1981 by the Senior Environmental Engineer on 05.03.2024.

It was brought out thatthe industry was granted 'consent to establish' (NOC) under the provisions of the Water Act, 1974 & Air Act, 1981 dated 18.07.2022 (Valid upto 17.07.2023) for production of Card Board/Mix Board @ 8 TPD by using Primary ETP sludge of pulp & paper mill as one of the raw material, subject to the following special conditions that:-
1. The industry will ensure compliance of standard operating procedures prescribed by CPCB for utilization of hazardous waste of category 32.3 i.e. primary ETP sludge of pulp and paper mill.
2. The industry shall re-circulate the entire effluent generated from the process and shall not in any case discharge its treated or untreated effluent.
The industry has now applied for obtaining fresh consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981.
The industry was visited by officer of the Board on 21.02.2024 and it was observed that the industry was in operation during visit and was found utilizing ETP sludge of pulp & paper mill (hazardous waste of category 32.3 of schedule-1 of HOWM Rules, 2016)without obtaining authorization &passbook for its utilization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and without valid consents to operate under the Water Act, 1974 & Air Act, 1981.
The industry is in operation without obtaining consents to operate under the Water Act, 1974 & Air Act, 1981 and is thus violating the provisions of the said Acts.
In view of above, show cause notice before refusal of 'consents to operate' granted under the provisions of the Water Act, 1974 & Air Act, 1981has been issued to the industry alongwith an opportunity of personal hearing on 05.03.2024, however neither any representative of the industry attended the hearing nor submitted any reply in the matter.
During hearing, the matter was deliberated by the Senior Environmental Engineer of the Board that the industry has started its operation for production of card board/mix board by using ETP sludge of pulp & paper mill (Hazardous of category 32.3 of schedule-I of HOWM Rules, 2016) without obtaining authorization and passbook under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 and without valid consents to operate under the provisions of the Water Act, 1974 & Air Act, 1981.
After considering the material facts on record and hearing the officer of the Board, it has been decided by the Senior Environmental Engineer of the Board that the consents to operate application applied by the industry under the provisions of the Water Act, 1974 & Air Act, 1981 is refused.
