• The industry was having valid CTOs upto 30.09.2023 under the Water Act, 1974 & Air Act, 1981 for manufacturing of Mix/Card Board @ 4.5 TPD by utilization of ETP sludge of pulp & paper mill @ 2.5 TPD and paralli/tudi/waste paper etc. @ 2 TPD…………...
• The industry earlier applied for obtaining varied consent to operate under the Water Act, 1974 & Air Act, 1981 for manufacturing of Mix Board @ 10 TPD by using wheat / paddy straw and sludge of paper mill @ 10 TPD……………..
• The industry proposed increase in the production capacity by the operating the existing machinery, but failed to submit area classification report/site suitability certificate as per the bye-laws of the notified master plan of Sri Muktsar Sahib………..
• Subsequently, show cause notice before refusal of 'consents to operate' under the provisions of Water Act, 1974 & Air Act, 1981 was issued with an opportunity to submit written reply in the matter, within 07 days………...
• The industry submitted the report of District Town Planner (DTP) dated 12.02.2024, wherein it was intimated that the site of the industry falls in the mixed land use zone of the notified Master Plan, Sri Muktsar Sahib, however, in the said report no site suitability/permissibility of such type of industry has been mentioned………...
• The matter was considered by the Competent Authority and decided to refuse the ‘consent to operate’ application applied by the industry under the provisions of the Air (Prevention & Control of Pollution) Act, 1981, which was refused vide Board' letter dated 14.02.2024………….
• Now application applied for obtaining consents to operate under the Water Act, 1974 & Air Act, 1981 for production of paper board @ 4.5 TPD by using wheat / paddy straw etc., @ 0.5 TPD & ETP sludge of pulp & paper mill @ 4 TPD………….
• It is pertinent to mention here that the industry was earlier granted CTOs for manufacturing of Mix/Card Board @ 4.5 TPD by utilization of ETP sludge of pulp & paper mill @ 2.5 TPD and paralli/tudi/waste paper etc. @ 2 TPD. The industry has also obtained authorization as well as passbook under HOWM Rules, 2016, which is valid upto 02.02.2026 for utilization of hazardous waste of category 32.3 @ 2.5 TPD………...
• The industry has submitted vide its letter dated 02.03.2024 that the paper mills sludge (32.3) is now more available from Satia Industries Ltd, Rupana and as this is a free raw as well as High Quality material for our industry and is available with lesser cost of carriage and is more viable for our agro based, Micro industry . So, it is requested that we may be allowed to utilize any raw material like Prali & OR Tudi & OR jute & OR Waste Paper & OR Paper Mills Sludge. We undertake that the utilization of raw material shall not exceed more than our production capacity and the utilization of ETP sludge (32.3) will go up to Maximum 4 TPD and .5 TPD will be other raw materials as mentioned above. Please allow the CTO with the use of UP TO 4 TPD ETP Paper Mill`s sludge and rest of other raw materials to attain the paper board production of 4.5 TPD. “As in present case, there will be no increase in the production capacity of the unit viz-a-viz no increase in pollution load………….
• The industry was visited on 11.01.2024 and the visiting officer has reported that the industry is complying with the provisions of the Water Act, 1974 & Air Act, 1981, Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 as well as with SOPs framed for such type of units………..
• In view of above, if approved, CTO under the Air Act, 1981 be granted to the industry for production of card board/ mix board @ 4.5 TPD by utilizing ETP sludge of pulp & paper mill @ 4 TPD and jute/paddy straw/waste paper etc. @ 0.5 TPD with validity upto 30.09.2024, subject to the following special conditions that:-…….
1. The industry shall not procure and process the hazardous waste of category 32.3 of Schedule-I appended to the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016 for its utilization beyond the permitted capacity i.e. 2.5 TPD as granted in the registration cum passbook issued to it on 03.02.2021 (valid upto 02.02.2026), till it obtains revised registration/passbook for utilization of category 32.3 of Schedule-I @ 4 TPD, which shall be obtained during the validity period of this consent……………
2. The industry shall ensure that in no case the production capacity of the industry exceed manufacturing of card board/mix board beyond 4.5 TPD………..
3. The industry will ensure compliance of SOPs prescribed by CPCB for such type of units, at all times………..
4. The industry shall ensure the compliance of conditions of consents to operate under the Water Act, 1974 & Air Act, 1981; authorization under the Hazardous & Other Waste Management Rules, 2016 and conditions stipulated while issuing registration certificate-cum-passbook, at all times………….
