File Note: It is submitted that the industry is a large scale orange category unit. Earlier, the industry was granted the consent to operate under Water (Prevention & control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2023/20461264 dated 23.01.2023 having validity upto 30.06.2023 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2023/20461170 dated 19.01.2023 having validity upto 30.09.2027 for manufacturing of yarn @ 7876 MTA by using virgin polyester @ 8413 MTA with special conditions mentioned therein. Thereafter, the industry was granted consent to operate under Water (Prevention & control of Pollution) Act, 1974 vide no. CTOW/Renewal/SAS/2023/22604739 dated 08.08.2023 having validity upto 31.12.2023 with subject to suitable condition and additional condition that the industry shall properly maintain the plantation area. Now, the industry has added machinery and increased its production and has applied for obtaining varied consent to operate under Water (Prevention & control of Pollution) Act, 1974 for manufacturing of yarn @ 16560 MTA by using virgin polyester @ 16390 MTA as raw material along with requisite documents and consent fee. However, the machinery has been installed in the shed already provided by the industry. The industry has already deposited Rs. 4,20,000/- vide UTR no. IDIBR52022081629684324 dated 16.08.2022 under the Water Act, 1974 and now the industry has deposited Rs. 2,04,000/- vide UTR No. IDIBR52024011037016326 dated 10.01.2024 under Water Act, 1974 and Rs. 2,04,000/- vide UTR No. IDIBR52024011037016334 dated 10.01.2024 as NOC fee, against the total cost of fixed assets is Rs. 16581.35 lacs as on 10.10.2023, which is valid upto 31.03.2027 after adjusting for NOC regularization fee. The industry has submitted land use classification, which show that the site is situated industrial zone and all type of expansion are permitted in the said industrial park in an area of 550 acre land confirmed by the DTP, GMADA vide letter no. 1722 dated 06/05/2016. The industry has submitted a copy of its lease deed, which is executed between M/s Nahar Industrial Enterprises Limited and M/s Owm Poly Yarn Limited i.e. from 01/10/2021 to 30/09/2031 for establishment of polyester based spinning unit in the existing premises of M/s Nahar Industrial Enterprises Limited (Unit-III) in the khasra no. 346 min (2-10), 347 min (2-10), 348 min (2-10), 349 min (3-0), 356 (4-0), 357 (4-0), 358 (4-0), 359 (4-0), 360 (4-0), 361 (4-0), 362 (4-0), 363 (4-0), 454/364 (0-2), 455/364 (1-18), 451/365 (1-0), 452/365 (0-18), 453/365(2-2), 448/366(0-18), 449/366(0-4), 450/366 min (1-18), 301 (4-0), 302 min (0-12), 456 (2-0) pieces 23 total land 57 Bigha 12 Biswa situated at village Jalalpur Tehsil Derabassi, Distt. SAS Nagar, Hadbast No. 217. The industry has submitted structure stability certificate prepared by Er. Mandeep Singh, Competent person, Regd with Director of Factories Punjab dated 03/05/2022. (Copy enclosed) The industry was visited by AEE of this office on 12.03.2024 and it was observed as under: 1) The industry is a spinning unit and was in operation during the visit. 2) The industry has installed following machinery in its premises: 05 Blow room line, 32 carding machines, 12 draw frame SB, 13 no. ring frame, etc. 3) The industry has provided 2 no. rotary filters with the blow room and 3 nos. with carding machines, which are adequate. 4) The total domestic effluent generation at full capacity shall be 70 KLD and the industry has already installed STP of capacity 200 KLD to treat the domestic effluent, which is adequate. 5) The industry has installed Sewage Treatment Plant for treatment of domestic effluent to be generated from industrial premises as well as labour quarters. STP installed by the industry comprises of collection tank, MBBR 1, MBBR 2, classifier, treated water tank, ACF, MGF, final treated tank, outlet. 6) The industry has installed flow meter at outlet of STP and as per the record about 42 KLD of effluent is being treated daily in the STP. 7) The industry has submitted analysis results from PBTI lab dated 4/7/2023 and results are as under:- pH= 8.24, TSS= 4.3, TDS= 551, BOD= 2.3, COD= 16, O&G= BDL, F.Coli= 33 As per analysis results all the parameters are within the prescribed limits of the board. 8) The industry has provided pipeline for carrying of treated wastewater from the outlet of STP to the green lawns developed in an area of around 5 acres inside the premises of the unit and in the green lawns/ park developed in front of residential colony of NIEL weaving unit in an area of about 3-4 acres. 9) Further, the PP has now developed karnal technology in 0.9 acres, in compliance to previous consent conditions. Now the industry has cleared the wild growth from the plantation area. The industry is complying with the conditions of the consents under the Water (Prevention & Control of Pollution) Act, 1974 earlier granted to it. In view of above, it is recommended that varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 may be granted for one year with subject to suitable conditions and special conditions that: 1. The industry shall submit effluent analysis results from board’s lab within one month. 2. The industry shall not carry out any activity in its premise, which can change the category of unit from Orange to Red, without prior permission from PPCB. 3. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 4. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 5. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received. 6. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time. 7. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
