It is submitted that the subject cited rice sheller has been established after obtaining consent to establish (NOC) vide no. CTE/Fresh/FZR/2023/21978016 dated 01.06.2023, valid upto 31.05.2024 for the manufacturing of Raw rice with dryer @ 5 TPH and Sorted Rice @ 5 TPH, under Orange category, with certain conditions mentioned therein. No specific condition has been imposed in the consent to establish (NOC) w.r.t. siting guidelines.
Now, the industry has applied for obtaining fresh consents to operate under the Water Act, 1974 and the Air Act, 1981, for the manufacturing of Raw rice with dryer @ 5 TPH and Sorted Rice @ 5 TPH. The detail of case is as under:-
• The industry has deposited Rs. 54,000/- vide UTR/Ref. No. N046242886645985 dated 15.02.2024 under the Water Act, 1974 and Rs. 54,000/- vide UTR/Ref. No. N046242886647753 dated 15.02.2024 under Air Act, 1981, against the fixed assets of Rs. 293.49 Lakhs as on 15.01.2024 as per CA certificate. Thus, the consent fee is adequate upto 30/09/2028 under each Acts.
The industry was visited by this office on 12.03.2024. and it was observed as under:-
1. The rice sheller unit in operation during visit.
2. The industry has installed machinery of rice sheller, for which NOC has obtained by it.
3. The industry has installed cyclone as APCD with shelling section and paddy pre cleaner dryer section. All dust emitting points were connected with hooding system and dust emissions were emitting from the dehuskers, elevators and paddy pre cleaners.
4. The industry has provided wall of adequate length and height 15 ft around husk storage area.
5. The industry has provided septic tank for treatment of domestic effluent however has not provided provision to discharge the same onto land for irrigation.
6. The industry has not planted adequate trees along its boundary wall.
The industry is not complying with the provisions of the Water Act, 1974 and the Air Act, 1981 as well as code of practice notified by the Govt. of Punjab, Department of Science, Technology & Environment vide notification no 10/48/2004-STE-(4) / 932 dated. 15/10/2013.
In view of the above, show cause notice for refusal of consent to operate under the Water Act, 1974 and the Air Act, 1981 may be issued to the industry.
