Sub: Proceedings of the personal hearing given before Chief Environmental Engineer, Ludhiana w.r.t u/s 33-A of the Water Act, 1974 as amended in 1988 and u/s 31-A of the Air Act, 1981 as amended in 1987 alongwith show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974. on 06.03.2024 - M/s Janta Enclave Main & Ext. I, II, III, IV, V, By M/S. Jlpl Infrastructures Pvt. Ltd., Village Dhandra, adjoining Dugri Urban Estate Phase II,Ludhiana.

Environmental Engineer, Zonal Office-2, Ludhiana brought out that the project proponent was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/LDH4/2019/8706938 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/LDH4/2019/8706927 dated 23.01.2019, both valid upto 30.09.2019 for residential plots @ 354 nos. commercial plots @ 46 nos. for disposal of domestic effluent @ 563.48 KLD into sewer (laid down by GLADA) with the special conditions mentioned therein.
The project was now visited by officer of the Board on 20.07.2023 and it was observed as under:-
1. The colony has approx. 80-90% occupancy.
2. The domestic effluent is being discharged into sewer.
3. The representative of the project informed that the solid waste is being disposed off at MSW dump site.
4. The project proponent has failed to submit half yearly detail of houses occupied as per consent conditions.
5. The project proponent has not obtained renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
The project proponent is violating the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
Accordingly, show cause notice for violation of the provisions of the Water Act, 1974 and Air Act, 1981 was issued to the project proponent with an opportunity of personal hearing before Senior Environmental Engineer, Zonal Office-2, Ludhiana on 25.10.2023.
After hearing, officer of Board and Deputy Chief Engineer of the colony, Senior Environmental Engineer of the Board decided that:
1. The project proponent shall apply for consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, within 07 days.
2. Environmental Engineer, Regional Office-4 shall visit the colony, verify the contentions made by the project proponent and submit the report alongwith conclusive recommendations, within 15 days.
Now, the colony was visited by the officer of the Board on 08.01.2024 and it was observed as under:-
1. The said colony has approx. 80-90% occupancy.
2. The domestic effluent is being discharged into sewer.
3. During visit, no representative of the colony was available at the site.
4. The Project proponent has not obtained renewal of consent to operate till date.
The project proponent has applied for Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 And Air (Prevention & Control of Pollution) Act, 1981 through OCCMMS for residential plots @ 354 numbers and commercial @ 46 number and discharge of domestic effluent @ 573.48 KLD into sewer.
The case was examined and it was observed as under:
1. The project proponent has not installed its own STP for treatment of domestic effluent generated from colony.
2. The project proponent has submitted a letter from MC regarding sewer connection but same was not clear that whether permission is granted to the project proponent for discharge of treated domestic effluent or untreated domestic effluent into sewer.
3. The Map attached by the project proponent is not clear. The total area of project mentioned in application form is 143461.1 sq. meter. It is a group housing project with ploting. The built up area of the project is more than 20,000 sq. meter. Hence, the project is covered in EC.
4. The project proponent has not submitted the latest approval/approved layout plan from the GLADA with clear cut detail of total land area/built up area etc.
5. The project proponent has not proposed any detail regarding utilization of treated effluent for various purposes such as back flushing, green belt etc.
6. The project proponent has not submitted the detail of Solid waste generation and its disposal arrangements. The colony has not provided Bio composter/composting pits.
7. The project proponent is violating the provisions of the Air (Prevention & Control of Pollution) Act, 1981.

Notice u/s 33-A of the Water Act, 1974 as amended in 1988 and u/s 31-A of the Air Act, 1981 alongwith show cause notice for refusal of consent to operate under Water (Prevention & Control of Pollution) Act, 1974 was issued to the project proponent with an opportunity of personal hearing before Chief Environmental Engineer, Ludhiana on 06.03.2024.
Sh. Hardeep Singh, Deputy Chief Engineer of the project attended the hearing and submitted a written reply which was taken on record. He stated that the sewerage network of their colonies has already been connected with the main sewer of the MC and hence, the domestic sewage generated from their project is being discharged into MC sewer which is further leading to STP at Balloke. The NOC for disposal of sewage has been already granted by MC, Ludhiana vide letter dated 03.05.2012. He further informed that their colonies were approved dated 20.09.1996 vide licence no. 96/12 and earlier consent to operate and its renewals have been granted on the same layouts. The solid waste generated from our project is being disposed off to MC, Ludhiana solid waste processing site for which MC, Ludhiana has already given permission. He is further informed that all the open space, green area and roads have been handed over to GLADA and sale deed has also been registered in favour of GLADA.
After hearing, the deputy chief engineer of the project and officers of the Board, the Chief Environmental Engineer of the Board decided as under:-
1. Consents to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be renewed to project proponent upto adequacy of consent fee with usual conditions.
Submitted for confirmation of decisions of the hearing and conveying to the all concerned, please.
