It is intimated that the poultry farm is a green category unit and engaged in the business of layered bird poultry farm having birds approx. 40,000 number and producing eggs. The poultry farm had applied consent to operate under the Water Act, 1974 and the Air Act, 1981 on 14/09/2022 and 14/11/2022 and both the applications were returned to the poultry farm due to incompletions. Thereafter, the poultry farm has not applied for consent of the Board.
Accordingly, a show cause-cum-personal hearing notice was served to the poultry farm for violating the provisions of the Water Act, 1974 and the Air Act, 1981 vide this office letter no. 529 dated 19.02.2024.
Sh. Vivek Sidhwani, partner of the poultry farm appeared before Environmental Engineer, Regional Office, Sangrur on 22.02.2024 and after hearing following decisions were made :-
1. The poultry farm shall apply for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981 within 7 days after the operation of OCMMS portal of the Board.
2. Assistant Environmental Engineer-I, Regional Office, Sangrur shall visit the poultry farm after a week to verify contentions made by the poultry farm during hearing.
The proceedings of said hearing has been conveyed to the industry vide letter no. 890 dated 14.03.2024.
Now, the poultry farm has applied for obtaining consent to operate under the Water Act, 1974 and the Air Act, 1981 for Chicks @ 8000 Numbers/Day and Layer Birds @ 38000 Numbers/Day by using Maize, Soya, Mustard, Sunflower, DOC, Bazra, Limestone & GNE @ 4 T/day and chick mash @ 4.4 T/day as raw material under small scale green category.
The poultry farm has submitted electricity bill as proof of date of commissioning wherein the date of connection is mentioned as 10.08.2012.
The poultry farm has deposited consent fee of Rs. 30,600/- vide no. N248222105662352 dated 05.09.2022 under the Water Act, 1974 and Rs. 30,600/- vide no. N248222105662352 dated 05.09.2022 under the Air Act, 1981 (which include Rs. 5000/- fee under each act as per VDS circular and Rs. 1400/- as NOC fee) against the value of fixed assets of Rs. 20.79 lakh as per CA certificate dated 19.05.2022 under VDS scheme. The fee deposited by the poultry farm is adequate upto 30.06.2035.
The poultry farm has submitted letter issued from office of SDM, Barnala vide no. 1314 dated 30.08.2022, as per which the various distances from poultry farm are as under:-
1. The poultry farm is situated at khasra no. 230 min-716/231-718/232. There are 03 no. houses in area of 500 mtr of the poultry farm.
2. There is no canal/lake in area of 200 mtr of the poultry farm.
3. There is no drinking water source in area of 500 mtr of the poultry farm.
4. There is no cold water storage tank in area of 100 mtr of the poultry farm.
5. Distance of National Highway from poultry farm is 150-200 mtr.
6. Distance of State Highway from poultry farm is 100 mtr.
7. Distance of road from poultry farm is 10-15 mtr.
To verify the fact of the poultry farm, the site of the poultry farm was visited by the officer of this office on 09/01/2024 and it was observed as under:-
1. The poultry farm was open during visit. Poultry farm has 2 single story shed, 2 double story shed, 1 double story chick shed having total 40,000 birds.
2. The poultry farm has now provided the cyclone on its feed mill. The poultry farm has also provided the concrete tank for excess drinking water cage from sheds & being disposed of onto land for plantation.
3. The separate septic tank has been also provided for the disposal of treated effluent onto land for plantation.
4. The one concrete pit has been also provided for dead birds.
5. The poultry farm located at Village Sohan Patti, Bajakhana Road, Barnala and was in operation.
6. There is no residential zone/houses, poultry/dairy, zoo sanctuary in the radius of approx. 500 mtr from the site of the poultry farm. Only 3 houses are there near this poultry farm. There is no any water body and national highway in the radius of approx. 200 mtr, there is no drinking water source and state highway in the radius of approx. 100 mtr from the site of the poultry farm.
7. The birds littering is supplied to the farmers as manure by the poultry farm. During visit, no flies were observed at site.
8. The poultry farm has own feed mill with provided cyclone as APCD.
9. The poultry farm is generating domestic effluent @ 0.8 KLD which is discharged onto land for plantation after passing through septic tank.
10. The poultry farm is not generating any trade effluent.
11. The poultry farm has installed one D.G set of capacity 20 KVA with canopy.
As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for 05 years, 10 years & 15 years respectively.
In view of above, it is recommended that consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the poultry farm upto 30.06.2035 (upto adequacy of fee) with usual conditions and special condition that the poultry farm shall comply with the guidelines prescribed by CPCB and shall comply with the provisions of Master Plan as and when notified by the competent authority.
