File Note: It is submitted that the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. PTA/WPC/2004-13/F-25 dated 05.02.2004 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. PRA/APC/2004-13/F-25 dated 05.02.2004, both was valid upto 28.02.2013 for discharge domestic effluent 0.300m3/d onto the land for plantation/irrigation after treating in a septic tank and discharge of trade effluent @.020 m3/d subject to conditions mentioned therein. The industry was given an opportunity to show cause in person before the Senior Environmental Engineer (ZP-1) of the Board in his office at Vatavaran Bhawan, Nabha Road, Patiala on 22.05.2023. After hearing the representatives of the industry and officers of the Board, Senior Environmental Engineer, Patiala decided that: 1. The Environmental Engineer, Regional Office, shall process the consent applications applied by the industry under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 on merit within stipulated time. 2. The industry shall maintain the record of fresh water used in washing, generation of effluent and the effluent got evaporated in the pan evaporators. 3. The industry shall not discharge any of its trade effluent into any sewer/drain/ river/choe/ nallah/inland surface water in an illegal manner. The proceedings of the personal hearing were conveyed to the industry vide Board’s letter no. 4019 dated 31.05.2023. The industry had last applied for consent to operate under the Water Act, 1974 and Air Act, 1981 on 21.05.2023 and the applications was returned at scrutiny level. Now, the industry has again applied for obtaining extension of consent to operate under Water (Prevention and Control of Pollution) Act, 1974 and fresh consent to operate under the Air (Prevention and Control of Pollution) Act, 1981 for production of Tablets @ 50000 Numbers/Day, Capsules @ 25000 Numbers/Day, Liquids @ 1000 Liter/day by using Ambroxol @ 1 Kgs/day, Ammonium Chloride @ 144 Kgs/day, Ampicillin Trihydrate @ 116 Kgs/day, AmoxycillinTrihydrate @ 10 Kgs/day, CefiximeTrihydrate @ 11 Kgs/day, Chlorzoxazone IP @ 6 Kgs/day, Clarithromycin IP @ 90 Kgs/day, Diclofenac sodium @ 61 Kgs/day as raw material under orange category alongwith requisite documents. The industry has deposited consent fees of Rs. 28500/- vide R no. 4588 dated 18.06.2018, Rs. 14500/- vide UTR dated 06.09.2022 (attached with application no. 20131303), Rs. 8700/- vide R no. 228101967 dated 21.05.2023 (attached with application no. 22130111) under Water (Prevention & Control of Pollution) Act, 1974.. The industry has deposited Rs. 28500/- vide R no. 4588 dated 18.06.2018, Rs. 14500/- vide UTR dated 06.09.2022 (attached with application no. 20131286), Rs. 8700/- vide R no. 961112123 dated 21.05.2023 (attached with application no. 22130088) under the Air (Prevention & Control of Pollution) Act, 1981 against the fixed assets of the industry @ 33.90 lacs as on 31.01.2024. The consent fees is adequate upto 30.09.2024 under each Act separately, after deduction of 700 percent penalty fees . The industry was visited by the undersigned on 13.2.2024 and contacted Sh. Shiv Shankar Shrivastav , rep at site . During visit, it was observed as under: 1. The unit is located opposite Apollo Public School, Deelwall Chowk at the backside of Urban Estate, Phase-1 .The area is surrounded by residential houses , school and some commercial shops . 2. The industry was not in operation during visit and it was observed that industry has installed machinery to manufacture capsules, tablets and liquids medicines after formulation. The liquid medicine filling machinery require CIP after preparation of a batch and the rep informed that only about 10-15 lts of fresh water is used . 3. The trade effluent being generated is collected in underground pucca tank and thereafter lifted through pump to electric evaporator kept on the roof top for treatment. The rep. of the industry informed that fresh water is taken from the submersible pump from the adjoining house owned by him. 3. The domestic effluent is being discharged into public sewer directly and sewer line from village Deelwal is connected to terminal STP Chaura 4 MLD. 4. The industry has not provided any D.G. set in its premises. The industry is located in Village Deelwal and the area falls in the residential zone as per the Notified Master Plan of Patiala . The industry has obtained CTO from the Board in 2004 and the master plan of Patiala was notified in the year 2010. The industry has not submitted any document of spot zoning from DTP office. It is pertinent mention here that the Board vide its order no. 21 dated 8/6/2018 has decided as under: “The existing industrial units/other establishments, which were establish before the notification of the Master Plan of the respective city shall be allowed consents/extension under the provision of Water Act, 1974, Air Act, 1981 & authorization under the provisions Hazardous Waste Management Rules, 2016 for a period 15 years from the date of notification of Master Plan after taking the concrete documentary proof regarding the date of commissioning of such units. No separate approval from Local Bodies/Other Authorities is required to be obtained. The orders shall be applicable for the whole of the State of Punjab”. Therefore the application can be considered for grant of grant of consent to operate under the said Acts upto 30.9.2024. In view of the above, may if approved, recommendations may be sent to SEE ZO-1 Patiala that consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 30.9.2024 for manufacturing of Tablets @ 50000 per/day, Capsules @ 25000 per/day, Liquid @1000 ltr/day by using Ambroxol @1 Kgs/day, Ammonium Chloride @144 Kgs/day, Amoxycillin Trihydrate @10 Kgs/day, Ampicillin Trihydrate @116 Kgs/day, Cefixime Trihydrate @11 Kgs/day, Chlorzoxazone IP @6 Kgs/day, Clarithromycin IP @90 Kgs/day, Diclofenac Sodium @61 Kgs/day to suitable conditions and following additional conditions that: 1. The industry will get clearance from DTP, Patiala regarding operation of the unit at the existing premises otherwise the industry shall be bound to shift its unit to the designated area as per Notified Master Plan of Patiala. 2. The industry shall provide flow meter on the fresh water pipeline coming from the adjoining house and maintain record of the same . 3. The industry shall not discharge its trade effluent into any drain/un-authorized mode. 4. The industry shall obtain necessary clearance for abstraction of ground water from Punjab Water Regulation and Development Authority (PWRDA).
