File Note: 1. It is intimated that the construction project is covered under small scale orange category. 2. The project proponent has obtained CLU from Department of Town & Country Planning, Punjab vide letter no. 1443 STP(L)/TW12A dated 16.06.2021 for the project in an area measuring 109K -1M (13.63 Acre) located at Village Alamgir (HB No. 273, Tehsil & District Ludhiana. The industry has submitted approved site plan from Senior Town Planner, Ludhiana issued vide no. 1612 STP(L) B.A.-I dated 06.07.2021. 3. Further, the project proponent is not required to obtain Environmental clearance under EIA notification dated 14.09.2006, as the project is an plotted society having less than 50 hectare of land area. 4. The project proponent has obtained NOC from the Board vide no. CTE/Fresh/LDH4/2022/17706622 dated 23/06/2022 valid upto 22.06.2023 for following :- a. RESIDENTIAL PLOTS = 79 NOS. (Plotting) in 13.63125 ACRE . b. E.W.S PLOTS = 10 NOS. (Plotting) . c. COMMERCIAL PLOTS (TRIPLE STORY) = 20X3= 60 NOS. d. SCHOOL = 1 NO. e. COMMON FACILITY CENTRE = 1 NO f. Domestic Effluent @78.6 KLD with 23.5 KLD will be reused after STP for sanitation/flushing in toilet and 55 KLD onto land for plantation area of 2acres after STP out of which 0.8 acre provided for karnal technology and 1.20 acre will be green belt. 5. Now, the project proponent has applied for Consent to operate under the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS along with requisite documents for the complete project as mentioned above. 6. The project proponent has submitted a CA certificate and upto 31.03.2023 it has expended Rs 9.26 crore at site. It has deposited Rs. 90,000/- vide R no. 605584308 dated 29.02.2024 as CTO fee under Air Act,1981 and Rs. 90,000/- vide R no. 530719177 dated 29.02.2024 as CTO fee under Water Act,1974 which is adequate upto 31.03.2028. 7. To very site conditions, the site of the project was visited by AEE of this office on 14.03.2024 and it was observed as under:- a. The project is located at Village Alamgir (HB No. 273, Tehsil & District Ludhiana. It is a residential colony with walk through commercial shops. b. The residential component of the project is under construction. No house has been occupied, construction of four houses was going on at the time of visit. The EWS plotting is yet to be done, The school is yet to be constructed. The community Centre has not been constructed at site till date. c. Around 18-19 commercial showrooms have been occupied and are fully operational including the eateries and food shops. d. The project proponent has installed STP but it has not submitted its completion report mentioning all is components. The ladder arrangement has not been provided to inspect its components. e. It has not installed water meter at its outlet and no record of fresh water consumption and effluent stp maintained. f. It has not installed Energy meter at its STP and no record of operation has been maintained. g. The project has yet to provide adequate area as proposed in its NOC application as per karnal technology for utilization of its effluent from its STP. h. No effluent was found in the aeration tank of the STP. No effluent was found at its outlet due to which its samples could not be collected from its outlet. i. The project proponent has not submitted any documents of land to be used for developing Karnal Technology. j. The project shall be generating about 890 kg of solid waste per day, which shall be segregated into biodegradable and non-biodegradable waste. The project has not provided Mechancial Bio-composter at site and is not segregating and maintaining the record of solid waste generation as per the provisions of Municipal Solid Waste Management Rules, 2016. k. It is relevant to mention here that the occupancy of the residential component of the project has not yet started but it has applied for CTO for the whole project with its complete discharge, which is not practical. Further, the project is still in construction phase and most of the construction components proposed by it at the time of its NOC are not even started, As such the project proponent is required to obtain the partial consent of 25% of its proposed final discharge after its completion or actual discharge whichever is higher and also it is required to obtain the NOC extension for its remaining construction. l. The project has not provided adequate Hazardous waste i.e. used oil from DG sets collection, storage and handling arrangements at site and has also not obtained authorization under the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016 . m. The project is found to be not complying with the NOC conditions, provisions of the Water Act, 1974 & Air Act,1981 and Solid waste management rules,2016 and hazardous waste management rules,2016. In view of the above, it is recommended that the Consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be refused and action may be taken against the project proponent for violating the environmental laws as mentioned above.
