File Note: The industry has applied for obtaining fresh ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for manufacturing of Liquid Syrup (Nutraceutical) @ 3000.0 Liter/day, along with requisite document. The industry has established its unit without obtaining ‘Consent to establish’ from PPCB and has directly applied for obtaining ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has deposited Rs. 64800/- vide R no. 629165537 dated 08.03.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 54500/- vide R. no. 650302918 dated 08.03.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.09.2027, (Considering NOC regularization fee of Rs. 10800/-and penalty) for both the Acts against the assets of Rs. 4.53 cr. on 10.02.2024. Manufacturing process: Raw Material Mixing Sieving Filling The industry has submitted a copy of GST registration certificated dated 01.09.2023, as a proof of date of commissioning of the unit, along with the online application form. The industry has also submitted a copy of building plan signed by Er. Lokinder Bansal, Competent Person of Director of Factories of Punjab. Suitability of site: The industry has submitted a copy of registry dated 16.06.2022 executed between M/s Blaze Furnishers Private Limited (seller) and M/s Hauz Pharma Pvt Ltd.,(purchaser) for plot no. D-20, Focal point, Derabassi. Further, the industry vide online reply dated 15.03.2024 has submitted a copy of letter no. 8167 dated 30.05.2022, vide which PSIEC has accorded permission to M/s Hauz Pharma Pvt. Ltd., for manufacturing of pharmaceutical products. As such, the site of the industry is suitable. Applicability of EIA notification dated 14.09.2006 The industry has proposed to setup a manufacturing unit for formulation of medicines and shall not be carrying out manufacturing of API/Bulk drug, thus, the proposed manufacturing activity of the unit is not covered under the ambit of EIA notification dated 14.09.2006. Visit: Accordingly, the industry was visited by AEE of this office on 14.03.2024 and during visit, it was observed as under: 1. The industry is a formulation unit and has installed machinery for manufacturing of Liquid Syrup (Nutraceutical) @ 3000.0 Liter/day. The unit was not in operation during the visit and the representative informed that the unit is yet to be made operational. 2. The source of fresh water supply is PSIEC supply and the same has been provided with flow meter to adjudge the quantity of water consumed by the industry. 3. As such no trade effluent shall be generated from the process and the only source of trade effluent generation shall be during CIP of the wet mixer vessels and floor washing. 4. The industry had installed an electric evaporator, which shall be used for the evaporation of the trade effluent. 5. The industry has installed separate energy meter for the evaporator and was advised to install flow meter at the inlet of the evaporator. 6. The domestic effluent being generated from the unit is discharge into PSIEC sewer. 7. The industry has installed 01 no. DG set of capacity120 KVA, which is equipped with canopy and stack of adequate height. From above, it is clear that the industry is complying with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, if may approved, the industry may be granted fresh ‘consent to operate’ granted to the industry under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, upto 30.09.2027 with usual conditions & with following special conditions: 1. The industry shall not carry out any activity, which can change in category from Orange to Red, under any circumstances. 2. The industry shall carryout only formulation process in its premise and shall not carryout API/bulk drug manufacturing, under any circumstances. 3. The industry shall not carry out any activity which is covered under EIA notification dated 14.09.2006. 4. The industry shall operate its electric evaporator efficiently, at all times and shall maintain a proper record of readings of operation of the said evaporator. 5. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 6. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 7. The industry shall not install any boiler/furnace or any source of air pollution in its premises, without prior permission from PPCB. 8. The industry shall ensure that no problem related to pollution is being caused by the unit due to its operation and no public complaints are received by the Board in this regard. 9. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 10. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 11. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 12. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
