File Note:  The industry is already running a partnership deed firm under the name & style M/s Gupta Shivam Dyeing Processors at Geeta Nagar, Tajpur Road, Ludhiana with discharge into Conveyance system of CETP. The industry is granted shares 522 KLD. Now, the industry has proposed to shift their existing unit from Geeta Nagar, Tajpur Road, Ludhiana to Village Bhamian Kalan, Tajpur Road Ludhiana.  Earlier, the industry has applied Consent to Establish NOC under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981, accordingly show cause notice for refusal of Consent to Establish NOC under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry with opportunity of personal hearing before the CEE, Ludhiana on 17.07.2023 for refusal of Consent to Establish NOC under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981. During the hearing following decisions were taken:- 1. The industry shall submit the following data w.r.t. new unit to the Regional Office-3 of Punjab Pollution Control Board, Ludhiana, within 15 days: • The industry shall submit data regarding abstraction of ground water / fresh water supply for the last three months. It shall provide EMFs on all sources of fresh water if not provided earlier. • The industry shall earmark on map the location of all active / closed submersible pumps / fresh water sources. • Details of dyeing machinery / other water consuming machinery along with specifications including production capacities specifying liquor ratio, number of lots, water consumption per lot, thus calculating the total fresh consumption (with duly authentication by the supplier of the machines). • Numbers of shares held by the industry (duly certified by the SP) and it shall submit NOC from PDA / SPV regarding proposed discharge into common sewer of CETP. • The industry shall get its shares demat and submit the documentary evidence in this regard. 2. Environmental Engineer, Regional Office-3, Ludhiana to authenticate the data certified by the industry and submit a conclusive report with regard to production to be allowed to the industry as well as corresponding effluent discharge, after one week of the submission of the above data by the industry. 3. In case of failure of the industry to submit the data as above, the recommendations be sent by the Environmental Engineer, Regional Office-3, Ludhiana to decide the NOC application accordingly on merits.  The industry was failed to submit the compliance of above said decisions, accordingly Consent to Establish NOC under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 was refused.  Now the industry has again applied for ‘Consent to Establish’ (NOC) under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for dyed acrylic yarn @ 1900 Kgs/day, dyed polyester fabric @ 10000 Kgs/day and dyed PC fabric @ 3750 Kgs/day with discharge of trade effluent @ 519.5 KLD & domestic effluent @ 2.5 KLD into conveyance system of CETP 50 MLD. The industry has deposited Rs. 10,800/- vide R. No. 738424565 dated 12.02.2023 as NOC regularization fee, which is valid for one year.  The industry had submitted copy of CLU from DTP, Ludhiana vide no. 584/DTP(L)/M-2A dated 15.03.2022 mentioning that the site of the industry falls in Industrial Land Use Zone as per Master Plan Ludhiana (2007-2031).  The industry has submitted certificate issued by PDA stating that the industry is a member of PDA and it was allotted 522 shares. The industry has also submitted certificate from Company Secretaries stating that 255 KLD shares has been DEMAT and 266 KLD are yet to DEMAT.  The industry has proposed to install 7 cabinet dyeing machines (6 of 120 Kgs & 01 of 60 Kgs) after shifting from its existing old unit and has also proposed to install 4 soft flow dyeing machines of capacity of 300 kgs(02 chamber) at proposed site and the industry has submitted an undertaking regarding machinery to be installed. • • As per audit carried out by GNE College, the approximate generation of effluent from the proposed machinery shall remain about 160 KLD from 08 chambers of soft flow machines considering generation of 20 KLD per chamber and 316.8 from all 07 cabinet machines. Hence the total generation of effluent shall remain (160+316.8 =476.8 KLD), which will remain within the quantum of shares obtained by the industry. • The industry has proposed to discharge trade as well as domestic effluent @ 522 KLD (519.5+2.5) into sewer network of CETP 50 MLD. • The industry has proposed to install one boiler of capacity @ 4.5 TPH with multi cyclone as APCD. The Rice husk/agro waste/ wood will be used as fuel in its boiler. • The industry has proposed to install 01 DG set of capacity 250 KVA with canopy and adequate stack height.  The industry was visited by the AEE of this office on 14.03.2024 and it was observed that:- 1. The unit is located at Tajpur Road, near M/s Media Impex. The construction work of the building has been completed. 2. The industry has installed some knitting machines inside the premises and no dyeing / washing machinery is installed at site yet. 3. The industry has not started installation of boiler at site yet. Since the site is situated in the industrial land use pattern of notified master plan Ludhiana and has also obtained shares from the PDA, consent to establish can be granted to the industry. In view of above, it is recommended that ‘Consent to Establish’ (NOC) for dyeing of acrylic yarn @ 1900 Kgs/day, dyeing of polyester fabric @ 10000 Kgs/day and dyeing of PC fabric @ 3750 Kgs/day with discharge of trade effluent @ 519.5 KLD & domestic effluent @ 2.5 KLD into conveyance system of CETP 50 MLD may be granted to the industry for the period of one year subject to the following special conditions:- • The industry shall shift entire proposed cabinet machines from its existing unit at Geeta Nagar. • The project proponent shall close down the operation of existing firm situated at Geeta colony before the commissioning of proposed site at Bhamian Kalan. • The industry shall not commission its machinery without getting consent to operate of the Board.
