It is submitted that the project is a small-scale orange category unit and the project has applied for fresh Consent to establish/NOC under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 through OCMMS for premix @ 250 TPH, Ready mix Concrete Cement @ 60 m3/h, Tiles/Inter-Locking Pavor/Curve Stone Etc. Products @ 10000 Numbers/day and Curve Stone, Bridge Paver & Tiles @ 250 Numbers/day and for discharge of domestic effluent 0.5 KLD into plantation after treatment through septic tank.
The industry has deposited Rs. 10800/- vide R No. 642098274 dated 13.03.2024 as NOC Regularization Fee, which is adequate upto one year.
The industry was visited by the officer of this office on 15.03.2024 and it was observed as under:-
1. The project has not yet started any construction and land is lying vacant.
2. The project proponent has proposed to install hotmix plant with dryer drum with gravity dust settling chamber, water scrubber as APCD, 02 no. Bitumen burners, batch-mix plant with dryer drum with bag filter, water scrubber as APCD, 01 no. Bitumen burners, RMC plant and 01 no. Mixture plant.
3. The project proponent has submitted feasibility report for installation of hot mix plant.
4. The project proponent has proposed to install 03 no. D.G sets of capacity @ 380 KVA, 125 KVA and 25 KVA with canopies and adequate stack height.
5. The project proponent has proposed to provide the septic tank for treatment of domestic effluent with provisions to discharged onto land for plantation area.
6. The project proponent has submitted DTP certificate from District Town Planner, Ludhiana vide 599 dated 11.03.2024 mentioning that the site falls and as per certificate “ਉਪਰੋਕਤ ਵਿਸ਼ੇ ਸਬੰਧੀ ਇੰਨ-ਪ੍ਰਿੰਸੀਪਲ ਅਪਹੂਲ ਲਈ ਫੀਸਾਂ ਦੀ ਵੈਰੀਫਿਕੇਸ਼ਨ ਸਬੰਧੀ ਆਨਲਾਈਨ ਕੇਸ ਪ੍ਰਾਪਤ ਹੋਇਆ ਹੈ। ਸਾਈਟ ਵਾਕਿਆ ਪਿੰਡ ਫੱਲੇਵਾਲ (ਹ.ਬ.ਨੰ. 311), ਤਹਿਸੀਲ ਅਤੇ ਜਿਲਾ ਲੁਧਿਆਣਾ (ਰਕਬਾ 1.05 ਏਕੜ) ਵਿਖੇ ਪੈਂਦੀ ਹੈ। ਸਾਈਟ ਵਿੱਚ Hot mix batch mix RMC plant ਆਗਿਆ ਯੋਗ ਹੈ। ਬਸ਼ਰਤੇ ਜੇਕਰ ਪ੍ਰਾਰਥੀ/ਫਰਮ ਦੀ ਸਾਈਟ ਭਵਿੱਖ ਵਿੱਚ ਬਣਨ ਵਾਲੇ ਮਾਸਟਰ ਪਲੈਨ ਨੋਟੀਫਾਇਡ ਹੋਣ ਸਮੇਂ Non-confirming zone ਵਿੱਚ ਆ ਜਾਂਦੀ ਹੈ ਤਾਂ:-
“ The applicant shall be liable to abide by the provisions of Master Plan and shall also be bound to follow the provisions of section 79 along with other provisions of PRTPD Act, 1995, in case the site falls in non-confirming land use zone after notification of Master Plan and no claim shall be demand by the applicant from the department.””
7. The project proponent has submitted project report as well as manufacturing process flow chart.
8. The industry has submitted distance certificate from Tehsildar Ludhiana (South) dated 26.02.2024 mentioning that: -
• The site is located 5 KM away from the Municipal Corporation, Ludhiana.
• The site is located 2 KM away from class-A Town and city limits.
• The site is located 1 KM away from other town and city limits.
• The site is located 500 mtr away from the Lal Lakir/Firni of village.
• The site is located 500 mtr away from the Wild life and Bird Sanctuary.
• The site is located 500 mtr away from National highway/bypass/State Highway/Scheduled Road.
• The site is located 500 mtr away from Residential colony and 15/25 pucca houses.
• The site is located 500 mtr away from Education Institute/Historical Places/ Religious places and protected monuments.
• The site is located 1 Km away from hospital, court and tourist spot.
Thus, the site is suitable for establishment of hot mix plant as per Board’s notification no. O3 dated 26.04.1999.
Keeping in view of above, it is recommended that the Consent to establish/NOC under the Water Act, 1974 and Air Act, 1981 may be granted to the project proponent for one year with suitable conditions and with special condition that: -
1. The hot mix plant will comply with the zoning regulation and if the site falls under Non-Confirming zone when the Master Plan get notified then the hot mix plant will comply with the guidelines under Rules 79 of The Punjab Regional & Town Planning and Development Act, 1995.
