Sub: Opportunity of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 13.03.2024 w.r.t. show cause notice for refusal of 'Consent to Establish' (NOC) under the Water Act, 1974 and Air Act, 1981 to M/s Rita Alloys, B-29--II-Kanganwal Road, Jaspal Bangar, Industrial Area-C, Ludhiana.
Due to some administrative reasons the Senior Environmental Engineer was out of station

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out on record that the industry is small scale red category unit and was earlier granted consent to establish (NOC) under Water Act, 1974 & Air Act, 1981 vide no. CTE/Fresh/LDH2/2019/ 9322829 dated 11/03/2019 expired on 10/03/2020 for installation of Induction Furnace of capacity 0.5 T/heat.
The industry has now applied for 'Consent to Establish' (NOC) for expansion under Water Act, 1974 & Air Act, 1981 for installation of Induction Furnace of capacity 1 T/heat and one cupola furnace.
On perusal of application, it has been observed as under:-
1. The industry has proposed to install one cupola furnace. The industry has not submitted feasibility report regarding installation of APCD.
2. The industry has proposed to install Induction Furnace of capacity 1 T/heat. However, as per PSCST certificate, there are two Induction Furnaces of capacities 1 T/heat and 0.5 T/heat.
In view of above, the industry was issued show cause notice for refusal of 'Consent to Establish' (NOC) under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 13.03.2024.
Sh. Kulbhush Mehta, Manager of the industry of the industry has attended the hearing and submitted written reply which has been taken on record. They have installed APCD with cupola furnace as per design of PSCST and submitted the completion certificate. The industry have installed only one induction furnace of 1 TPH capacity and installed APCD as per design of PSCST and completion certificate of the same is submitted. The industry has dismantled Induction Furnace of capacity of 0.5 T/heat.
After considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall not operate the induction furnace of capacity 0.5 TPH
2. The industry shall install only induction furnace of capacity 1 TPH and install APCD as per design of Punjab State Council for Science & Technology (PSCST) Chandigarh.
3. 'Consent to Establish' (NOC) under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 be granted to the industry.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
