Sub: Opportunity of the personal hearing given before the Senior Environmental Engineer, Zonal Office-I, Ludhiana on 13.03.2024 w.r.t. show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 to M/s Formative Engineering P Ltd (Unit-II), Village-Pawa, Near M.S. Bricks Kiln, Ludhiana.
Due to some administrative reasons the Senior Environmental Engineer was out of station

The Add. Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out on record that the industry is a Small scale orange category unit. The industry was granted consent to operate under the Water (prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/LDH2/2019/10320745 dated 16.08.2019 valid upto 30.09.2023 and under the Air (prevention & Control of Pollution) Act, 1981 vide no. CTOA/Varied/LDH2/2019/10321517 dated 16.08.2019 valid upto 30.09.2023 for manufacturing of Rough Steel Forgings items @ 09 TPD using various grades of iron & steel @ 11 TPD.
The industry has applied for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, without NOC of the Board.
The industry has made expansion without NOC of the Board by installing 1 induction heater and 02 shot blasting machines.
The industry has not submitted compliance of conditions of consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 in annotated form.
The industry is not complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Thus, violating provisions of said Acts.
In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 and Air Act, 1981 with hearing before the Senior Environmental Engineer of the Board on 13.03.2024.
Sh. Bharat Bhushan, Accountant of industry has attended the hearing and submitted written reply which has been taken on record. The industry has submitted that the industry was already having 2 Shot blasting machine. The industry has installed only 1 Induction Heater and deposited NOC regularization fee. They have attached the drawing of re-circulation system which is connected with cooling Tower. They have spare 510 sq. yards for plantations for discharge of domestic effluent.
After considering material facts on record, the Senior Environmental Engineer of the Board decided that:-
1. The industry shall re-circulate the cooling water and discharge only domestic effluent onto land for plantation.
2. The Environmental Engineer, Regional office-1, Ludhiana shall verify submission made by the industry and submit recommendations in view of land use pattern of the area.
Submitted for confirmation of decisions of the hearing and for conveying to the industry and Regional Office for compliance of above decisions, please.
