Senior Environmental Engineer, Zonal Office-1, Ludhiana On behalf of the industry Sh. Vijay Singh, Head Incharge The Senior Environmental Engineer, Zonal Office-1, Ludhiana brought out that the industry was granted consent to operate under the Water Act, 1974 and Air Act, 1981 both valid upto 31/03/2026 for the manufacturing of Motor cycle hub with panel @ 17000 Pcs/day, Motor cycle crank case cover @ 20000 Pcs/day, Motor cycle crank case @ 10000 Pcs/day, Other auto parts @ 23000 Pcs/day & Other non-auto parts @ 3000 Pcs/day. The industry was granted authorization under the Hazardous and other Waste Rules, 2016 vide no. HWM/renew/LDH1/2021/14493804 dated 25.06.2021 valid upto 24.06.2026. The industry was given personal hearing before the Chairman of the Board w.r.t. show cause notice for revocation of consents granted under the Water Act, 1974 alongwith notice for revocation of authorization granted under the Hazardous and other Waste Rules, 2016 as well as notice for imposition of EC on 25.09.2023, wherein, it was decided as under: 1. The industry shall appoint a dedicated person, who is expert in the field of pollution control, for the compliance of environmental laws in the industry. 2. To ensure that no industrial effluent is discharged into sewer, the industry shall submit a scheme within one month to achieve the zero liquid discharge for its industrial waste. The industry shall implement this scheme by 31.12.2023. 3. The industry shall store the Hazardous waste properly and shall apply for revised authorization within 10 days under the Hazardous & Other Wastes Rules, 2016 covering all the categories of hazardous waste generated in its premises. 4. The consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 and authorization under Hazardous & Other Wastes Rules, 2016 be revoked. 5. The industry shall submit a bank guarantee of Rs. 50 lacs, within 10 days, as an assurance to achieve ZLD by 31.12.2023. 6. The Environmental Engineer, Regional Office-I shall process the applications of the industry after verification at site and after monitoring the pollution control devices of the industry. The industry has applied now for obtaining consent to operate under the Water Act, 1974 and authorization under Hazardous and Other Wastes Rules, 2016. The industry was visited by officer of the Board on 30.11.2023 and it was observed as under: 1. The industry was in operation during visit was engaged in the process of manufacturing of auto parts from aluminum alloys involving the process of melting, casting, machining, shot blasting, painting, finishing etc., 2. The industry has installed the ETP for the treatment of its effluent generation from paint shop section and pressure die casting from process. The ETP was found in operation during visit and treated water was reused in component washing. The treated water is also used in chemical dozing. Trolley wash, flushing in washroom, in paint shop and remaining part in gardening. Hence entire treated effluent is reused inside the unit. 3. The industry vide its letter dated 28.12.2023 has submitted that they are moving ahead with ZLD in ETP with proposal of 90 % RO recovery i.e. 18 KLD from ETP output @ 20 KLD and remaining RO reject @ 2 KLD will be evaporated. The industry till date has failed to achieve the ZLD by 31.12.2023 as per the hearing decisions. The industry has signed an agreement with TSDF Nimbua Dera bassi Mohali and with M/s Gupta Metals, Faridabad, which is a recycler for disposal of HW under cat 11.5. M/s Gupta Metals has not obtained authorization for lifting and transportation of HW from the other States. Moreover the HW under cat.11.5 was earlier sold by the industry. Therefore its disposal at TSDF Nimbua needs to be clarified from the unit. In view of above, the industry was issued show cause notice for refusal of consent to operate under the Water Act, 1974 alongwith show cause notice for refusal of authorization under the Hazardous and other Waste Rules, 2016 with hearing before Chairman of the Board on 07.03.2024, postponed to 15.03.2024. Sh. Vijay Singh, Head Incharge of the industry attended the hearing and submitted a written reply, which was taken on record. He submitted that they are engaged in the process of manufacturing of auto parts from aluminum alloys involving the process of melting, casting, machining, shot blasting, painting, finishing etc. The industry has installed the ETP for the treatment of its effluent generation from process. They are in the process of finalizing the candidate having the knowledge of Environmental Laws. They have engaged a consulting agency "Sphera" who advises us on compliances relating to Environmental Laws. Vide our letter dated 28th December 2023 they have submitted the ZLD proposal on ETP outlet. In line with the proposal, they have issued the purchase order and by end of May 2024 they will have installed ZLD in ETP operation double RO filtration system along with evaporator. They have made all arrangements to store the Hazardous waste safely and have also applied for authorization under the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016 alongwith the consent to operate under the Water (prevention and control of pollution) Act, 1974. They have already submitted the Bank Guarantee of Rs.50 Lacs. For disposal of hazardous waste of category 11.5, M/s Gupta Metals with whom they have an agreement has applied for authorization. After hearing the industry, officers of the Board and considering material facts on record, the Chairman of the Board decided as under: 1. The industry shall comply with all the violations stated as above, immediately. 2. The industry shall finalize the order for installation of Zero Liquid Discharge (ZLD) plant, within 15 days. 3. The industry shall submit Progress Evaluation and Review Technique (PERT) chart for installation of ZLD plant, within 15 days. 4. The industry shall install and commission ZLD plant by 30.04.2024 and shall complete its stabilization by 31.05.2024. 5. From Bank Guarantee of Rs. 50 lacs submitted by industry, Rs. 5.0 lacs be encashed immediately and other amount of Rs. 5.0 lacs be encashed, if industry fails to complete its stabilization by 31.05.2024. 6. The industry shall comply with the provisions of the Hazardous and other Waste (Management & Transboundary Movement) Rules, 2016. 7. The consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 be granted upto 31.05.2024 as per compliance of above conditions. 8. The Environmental Engineer, Regional Office-2, Ludhiana shall verify submission made by industry, monitor progress and submit compliance report of hearing decisions alongwith recommendations in the matter, accordingly.
