It is intimated that the marriage palace is small scale orange category unit and was earlier granted CTO under Water Act, 1974 vide no. CTOW/Renewal/LDH4/2017/5120112 dated 07/03/2017 valid upto 16/09/2017 and under Air Act, 1981 vide no. CTOA/Renewal/LDH4/2017/5120106 dated 07/03/2017 valid upto 16/09/2017.
Thereafter, the marriage palace has obtained auto renewal consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTO/Renewal/LDH4/2023/24099118 and Air (Prevention & Control of Pollution) Act, 1981 vide no. CTO/Renewal/LDH4/2023/24101508 dated 02.11.2023, both valid upto 02.11.2029.
Further, the marriage palace was earlier visited by the officer of the Board on 11.12.2023 and observed that the marriage palace is violating the provision of Water Act, 1974, Air Act, 1981 and SWM Rules, 2016.
Accordingly, notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 as amended in 1988 and u/s 31-A of the Air (Prevention & Control of Pollution) Act, 1981 as amended in 1987 show cause notice for revocation of auto renewal consent to operate under both Acts alongwith was issued to the project proponent with an opportunity of personal hearing before Chief Environmental Engineer, Ludhiana on 23.01.2024, wherein it was decided as under: -
1. The auto-renewed consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 granted to the marriage palace be revoked.
2. Environmental Engineer, Regional Office-4, Ludhiana shall visit the marriage palace to verify its contentions and comment on the site suitability of the marriage palace, within 5 days.
3. The industry will be re-heard after one month.
A notice u/s 33-A of the Water Act, 1974 and 3-A of the Air Act, 1981 was now again issued to the marriage palace with opportunity of personal hearing before the CEE, Ludhiana on 02.04.2024.
Now, the marriage palace has applied for obtaining fresh consent to operate under Water Act, ,1974 and Air Act, 1981. The marriage palace has deposited Rs. 20000/- UTR no. 001305693276 dated 12.03.2024 under Water act, 1974 and Rs. 20000/- UTR no. 001305693416 dated 12.03.2024 under Air Act, 1981 against the CA certificate of Rs. 23.30 lacs. As such, the fee submitted by the industry is adequate up to 30.09.2028 under both acts after deducting NOC regularization fee and late penalty fee.
Now, the marriage palace was visited by the officer of the Board on 06.02.2024 and it was observed that: -
1. The unit is a standalone marriage palace, no function was undergoing at the time of visit.
2. The marriage palace has provided oil and grease tap followed by septic tank for treatment of effluent generated.
3. The marriage palace has constructed compost pits.
4. The marriage palace has installed water meter on source of water supply.
5. The treated effluent is being utilized onto land for plantation.
6. The marriage has installed one D.G set equipped with canopy.
As such, the marriage palace is now complying with the provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
In view of the above, it is recommended as under Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 may be granted upto 30.09.2028 with suitable conditions.
