Subject: Proceedings of the personal hearing given to M/s HSR Ventures, Vill. Chhat, Zirakpur-Banur Road, Tehsil Zirakpur, Distt. SAS Nagar w.r.t SCN for refusal of consent to operate applied under the Water Act, 1974 and the Air Act, 1981 before the Senior Environmental Engineer (P) of the Board on 18/3/2024

The officers of the Board brought out that the marriage palace was earlier given personal hearing before the Chief Environmental Engineer (P) of the Board on 18/12/2023. But, nobody from the marriage palace attended the hearing. However, it was decided that Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the marriage palace immediately and thereafter send the report alongwith fresh recommendations within 7-days.
The project proponent has applied for obtaining fresh consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for marriage palace @ 450 persons alongwith requisite documents. The site of the marriage palace was visited by officer of the Board on 29/2/2024 and it was observed that:
1) The project is a marriage palace and not in operational during visit.
2) As per the representative the marriage palace is having total gathering capacity of persons 900-1000.
3) The marriage palace has installed STP for treatment of domestic effluent and same was in operation during the visit. Further, the physical condition of the STP was not good and appeared that the same is not in operation since long time.
4) The marriage palace has not provided water meter at the source of fresh water.
5) The project proponent has not maintained the record regarding operation of the STP.
6) The untreated effluent is being onto adjoining farm land through pipeline as reported by the farmers in the adjoining field.
7) The solid waste is not being managed as per Solid Waste Management Rules, 2016. Further, the burnt solid waste was observed in the parking area.
8) The marriage palace has not provided composting for treatment of wet biodegradable solid waste.
9) The marriage palace has provided one rain water harvesting pit at the back side of the marriage palace, which was found filled with untreated effluent.
10) The marriage palace has installed one D.G set of capacity 125 KVA equipped with canopy but inadequate stack height.
The resort cum marriage palace is operating without obtaining consent to operate under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981. Also, the industry is not complying with the measures suggested for control of water pollution, air pollution & solid waste management mentioned in the mechanism guidelines framed by the CPCB and adopted by PPCB vide letter no. SEE(HQ-2)/2021/64 dated 2/2/2021.
The project proponent is violating the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981, willfully causing pollution in the vicinity, thus violating the provisions of the said Acts, intentionally and deliberately. It was proposed to refuse the consent to operate applied under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981, after affording an opportunity of show cause-cum-personal hearing.
Therefore, the industry was served show cause notice for refusal of consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981 vide no. 12609-10 dated 6/3/2024 alongwith an opportunity of personal hearing before the Senior Environmental Engineer (ZP-1) of the Board on 18/3/2024.
The representative of the industry attended the hearing and submitted written reply which was taken on record. He failed to give any satisfactory reply of the show cause notice issued under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981. However, he informed that the stack height of the DG sets have been raised as per the norms. He requested for grant of sometime to make the compliance of the observations earlier made by the visiting officer of the Board.
After hearing the representative of the industry and officer of the Board, the Senior Environmental Engineer (ZP-1) of the Board decided that:
1) The consent to operate applied under the Water (Prevention and Control of Pollution) Act, 1974 shall be refused due to violations made by the project proponent.
2) The project proponent shall install mechanical composter within 10-days for the management and handling of wet waste generated from premises of the palace after functions.
3) The project proponent shall comply with all the observations made by the visiting officer of the Board on 29/2/2024, within 10-days and submit the compliance to the O/o Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar thereafter.
4) The project proponent shall not burn solid waste under any circumstances.
5) The project proponent shall submit bank guarantee of Rs. 5.0 Lakhs/- as an assurance to comply with environmental laws within 7-days to the O/o Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar.
6) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall encash 50% bank guarantee to be submitted by bank guarantee i.e. Rs. 2.5 Lakhs immediately.
7) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall visit the palace surprisingly to verify the compliance of environmental laws made by the project proponent and thereafter send the recommendations including status of stack heights provided with DG set to decide the consent to operate applied under the Air (Prevention and Control of Pollution) Act, 1981 .
If approved, proceedings of the personal hearing as above may be conveyed to the industry and Environmental Engineer, PPCB, RO, SAS Nagar for compliance and sending the report, respectively.
