It is submitted that the industry was imposed a bank guarantee of Rs. 1.0 lac (under Air Act, 1981) as per the decisions taken in the personal hearing afforded to the industry by CEE, Ludhiana on 20.07.2021. Thereafter, the industry submitted a request for waiving off the bank guarantee and the same was sent to Zonal Office-2, Ludhiana for consideration. The request was considered and decided that the industry shall submit the bank guarantee in compliance of the decision of the Competent Authority and RO shall submit separate note for returning the bank guarantee as per protocol.
However, the industry has failed to submit the bank guarantee of Rs. 1.0 lac till date. Keeping the above in view, it is recommended that 'Consent to Operate' under the Air Act, 1981 may be refused.
