File Note: History of case: The project proponent was issued show cause notice for violations of the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 alongwith an opportunity of personal hearing before the Chief Environmental Engineer of the Board on 21.01.2024 and it was decided as under: 1) The proposed directions u/s 33-A of the Water (Prevention and Control of Pollution) Act, 1974 shall be confirmed to the industry for its closure. 2) Environmental Engineer, Punjab Pollution Control Board, Regional Office, SAS Nagar shall ensure the compliance of the directions as well as keep strict watch on the activities on the industry that the unit shall not be operated under any circumstances. Accordingly, PSPCL authorities were directed to disconnect the electricity supply available with the industry vide ZO letter no. 12438-41 dated 27/2/2024 and this office letter no. 909 dated 05.03.2024. In compliance to the said directions, PSPCL has disconnected the electric supply available to the industry. A copy of TDCO no. 100024752880 dated 11.03.2024. A compliance report in this regard was also sent to ZO on 14.03.2024 through e-office file no. 205627. Present application: Now, the industry has applied for obtaining ‘Consent to Operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for operation of the industrial unit engaged in Electroplating of Fasteners and Sheet Metal @ 500 Kgs/day as products, along with requisite document. The industry has deposited Rs. 13700/- vide UTR no. CBINH19358313382 dated 24.12.2019 and Rs. 5400/- vide no. 798912490 dated 19.03.2024 under the Water (Prevention & Control of Pollution) Act, 1974 and Rs. 11000/- vide UTR. no. CBINH19358306506 dated 24.12.2019 and Rs. 5400/- vide no. 33141112 dated 19.03.2024 under the Air (Prevention & Control of Pollution) Act, 1981, which is adequate upto 30.06.2025 (Considering Penalty fee and NOC regularization fee) for both the Acts against the assets of Rs. 5.10 lakhs on 11.03.2024. Manufacturing process: Stock cleaning Water Ring +2 Acid HCL (30%) Water RingAnadicWater RingZinc Plating (Tank) Drag out Water Ring Nitric Dip 1%  Trivalent Passivation Water Ring +2  Dry hot Packing Suitability of Site: The industry has submitted a copy of allotment issued vide letter no. 4795 dated 26.03.1991 issued by PSIEC to M/s Shri Devinder Singh, 445, sector 35-A, Chandigarh for manufacturing of Wire Drawing at Plot no. D-14, Focal Point, Derabassi. The industry has submitted a copy of lease deed dated 18.12.2018 executed between Sh. Devinder Singh and M/s Madhav Enterprises, which is valid upto 31.12.2028. Thus, the site of the unit is located in industrial focal point and is suitable. The industry has submitted a copy of GST registration certificated dated 24.01.2019, as a proof of date of commissioning of the unit, along with the online application form. The industry has also submitted a copy of building plan signed by Er. Rajnish Kumar Singla, Competent Person of Director of Factories of Punjab. The industry has submitted a copy of agreement executed with M/s Bantech Water Pvt. Ltd., Kurali vide dated 15.03.2024 for lifting trade effluent @ 2000 ltr. Visit: Accordingly, the industry was visited by AEE of this office on 20.03.2024 and during visit, it was observed as under: 1. The industry was not in operation during the visit and the electric connection was found to be disconnected. 2. The industry is engaged electroplating of fasteners and sheet metal @ 500 Kgs/day. 3. Source of water supply is PSIEC supply. 4. The domestic effluent being generated from the industry is discharged into PSIEC sewer. 5. The industry has installed 01 no. HCL dipping tank and 05 no. barrels & 01 no. tank for zinc plating of screws/fasteners of different sizes. 6. The industry has constructed 02 no. of underground storage tanks of capacity 2000 ltr. each for storage of trade effluent being generated from the process. 7. The industry has now made an agreement with the operator of CETP- M/s Bantech Water Pvt. Ltd., Kurali vide dated 15.03.2024 for lifting trade effluent @ 2000 ltr. the representative of the industry informed that they have now made an agreement with M/s Bantech and shall now get the trade effluent lifted from the operator of the said CETP only. 8. The industry has now cleaned the entire premises of the unit and no stagnation of wastewater was found in the open area. 9. The industry has not installed any DG set in its premises. From above, it is clear that the industry has now complied with the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Recommendations: In view of above, if may approved, following actions may be taken: A. The industry may be granted ‘consent to operate’ under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, for six months with usual conditions & with following special conditions: 1. The industry shall maintain proper record of generated, collection and disposal of trade effluent at the site, at all times. 2. The industry shall get its trade effluent lifted from the operator of authorized CETP only under proper manifest system. 3. The industry shall not discharge the effluent into any drain/choe/nallah, in any case. 4. The industry shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances. 5. The adequacy/ efficacy of the pollution control arrangements shall be the sole responsibility of the industry and the industry shall be bound to implement/ upgrade its pollution control arrangements as per the discretion of the Board to achieve the prescribed emission/ effluent standards, as amended from time to time. 6. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time. 7. The ‘consent to operate’ is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing. 8. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent. B.
