File Note: The unit is a sweets and other eatable manufacturing unit and was earlier in operation at gill road Ludhiana and now their manufacturing unit has been established in the village Nichi Mangli, Chandigarh Road, Ludhiana and earlier the occupier has applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and same was returned due to incompletions in application. Thereafter the industry was issued directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 with opportunity of personal hearing before the CEE, Ludhiana on 28.10.2022, wherein it was decided that:- 1. The industry shall install ETP within 1 month, so as to achieve the effluent discharge standards prescribed by the Board. 2. The industry shall submit a bank guarantee of Rs. 1.0 lacs within 07 days. As an assurance for the compliance of Pollution Control laws. In case of failure the same will be encashed without any further notice. 3. The industry shall submit within a period within 15 days a copy of permission from the Municipal Corporation, Ludhiana for the discharge of industrial effluent into sewer. 4. The industry shall obtain consent to establish/consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 within 15 days. Thereafter, the industry has again applied for consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981, the industry was visited by the officer of the Board on 10.01.2023 and it was observed that the industry has installed STP for treatment of effluent generating from the industry. The STP was under stabilization phase during visit. The treated effluent was being discharged into sewer through underground line due to the samples was not collected. The application of the industry was returned due incompletions. Thereafter the industry was again issued notice of directions u/s 33-A of Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 with opportunity of personal hearing before the Chief Environmental Engineer, Ludhiana on 20.06.2023 and no representative of the industry attend the hearing. After considering background of the case and material facts on the record, the Chief Environmental Engineer of the Board decided that the Environmental Engineer, Regional Office-1, Ludhiana shall visit the industry and shall submit flash report after monitoring the final outlet of the industry . Now the industry has applied for obtaining consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. The industry has filled online application form, uploaded, CA certificate, site plan location plan, manufacturing process, classification of area as industrial use vide DTP letter no. 3033 dated 22.12.2023, where all type of industries are permissible, feasibility report of STP, drawing of plantation, analysis report from NABL Lab. The industry has deposited Rs. 75600/- vide no. N348222247484489 dated 14.12.2022 under Water Act, 1974 and Rs. 75600/- vide no. N348222247495370 dated 14.12.2022 under Air Act, 1981, which is adequate upto 30.09.2030. The industry was visited by the officer of this office on 19.03.2024 and it was observed as under:- 1. The industry was in operation during visit. 2. The industry has installed 1 baby boiler of capacity 0.5 TPH with wood as fuel. Gravity settling chamber is acting as APCD. Stack of Adequate height along with proper sampling arrangements have been provided with it. The industry has also installed 1 thermo-pack of capacity 6 lac kcal/hr. which is also wood fired. The industry has installed 01 D.G. sets of capacity 89.850 KVA with canopy & adequate stack height. 4. The generation of trade effluent is from washing of utensils and containers used for cooking/manufacturing sweets. 5. The generation of effluent from the process of manufacturing of sweets is 3.5 KLD and domestic effluent is 5 KLD and both are treated in STP installed by the industry based on bio-logical process. 6. The industry has installed STP of 10 KLD capacity comprising of all the components required for bio-logical treatment, which are underground and the STP is a packaged unit and has been designed by a Japanese company namely Daikiaxis. 7. During the visit no effluent was being discharged due to non-operation of industry. However the industry has got its effluent analyzed from NABL laboratory on 11.03.2024 and as per the analysis report, the results are within the limits. 8. The industry has developed plantation area/green area in front of premises as well as within the premises, measuring 0.1 acres, which is sufficient for the disposal of effluent. Further the point wise compliance of the decisions of the personal hearing given to the industry is as under:- 1. The industry has installed ETP-cum-STP and is achieving the effluent discharge standards prescribed by the Board as per NABL report. 2. The industry has submitted bank guarantee of Rs. 1.0 lacs, as an assurance for the compliance of Pollution Control laws. 3. The industry is disposing its treated effluent onto land for plantation. 4. The industry has applied for obtaining consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Since, the industry is complying with the decisions of the personal hearing as well as with the siting guidelines(being in industrial zone) it is therefore recommended that Consent to Operate under Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted to industry upto 30.09.2029 as per the policy of the Board with suitable terms and conditions and special condition that the industry shall got its effluent and air emissions analyzed from Board's lab within 03 months, please.
