File Note: It is submitted that while scrutinize the case it has been observed that:- (1) The fixed assets of the industry were Rs. 3488.31 Lacs (with cost of Plant & Machinery Rs. 2079.99 Lac) as on 31.03.2022. Now, the fixed assets of the industry have been increased to Rs. 5045.99 Lacs (with cost of Plant & Machinery Rs. 3038.74 Lacs) as on 31.03.2023 i.e. Rs. 1557.68 Lacs increased in total fixed assets (with cost of Plant & Machinery Rs. 958.75Lacs).Hence, the industry is required to submit the complete detail of increased machinery with Bill No/Date/Amount/Type of machinery. (2) As per CA Certificate the cost of Land & Building account has also been increased from Rs. 742.22 Lacs as on 31.03.2021 to Rs. 918.93 Lacs as on 31.03.2023 i.e. Rs. 176.71 Lacs increased. Hence, industry is required to submit the Land use pattern of new land added and amended building plan from the Director of Factories (or) Competent Person authorized by the Director of Factories, Punjab. (3) Earlier, the Total Land area of the industry was 11700 Sq. Meters, Now the total land area of the industry is 15133 Sq. Meters, the industry has not submitted CLU/Land use pattern of the industry. (4) The industry has made an extension in Power Load from 999.206 KW to 1999 KW without obtaining NOC of the Board. (5) As observed during latest visit to the industry, it has been observed that the industry has installed the automatic Heat Treatment Plant without obtaining NOC of the Board after obtaining the New Shed, but details have not been mentioned in consent applications. (6) In light of Sr.No. (1) to (5), it is evident that industry has made an expansion without obtaining NOC of the Board. But the industry has applied for renewal of consents of the Board on the same quantity of product i.e. Fasteners and sheet metal components @ 25 MTD which were in 2022, whereas the Plant & Machinery has been increased from Rs. 2079.99 Lacs to Rs. 3038.74 Lacs (i.e. Rs. 958.75 lacs increased), Pl. clarify. (7) The industry has not filled the column 5 of Part-B (Technical Information) of Water consent application. (8) The industry has not filled the details in Part-B (Technical Information (General) and Part-D (Technical Information required for consent under Air Act, 1981) and all the columns have left blank. (9) In light of above, the industry was required to applied for varied consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 alongwith all required documents & Fee. But, the industry has applied renewal of consents under the both acts, which cannot be considered. (10) The industry has not submitted the feasibility report and completion of ZLD and water balance statement. (11) The industry has not submitted the record regarding operation of ETP/ZLD and chemicals consumption. (12) The industry has not submitted the Analysis report of treated trade effluent and treated domestic effluent from the Boards Lab. (13) The consent fee deposited by the industry is not adequate for next 5 years, as the industry is required to deposit the balance consent fee on the basis of fixed assets increased. (14) The previous consent obtained by the industry has been expired on 31.03.2023, hence industry is required to deposit the late fee also. (15) The industry has not submitted by the compliance report of previous consent conditions and NOC conditions if would have been obtained by the industry prior to expansion. (16) Please submit the copy of Plastic Waste Registration obtained by the industry. (17) Please submit the details of arrangement provided for handling of Solid Waste generated by the industry. (18) As the ETP based on ZLD technology has been commissioned. Hence, the industry is also required to apply for varied authorisation under the Hazardous and Other Wastes (Management and Transbounary Movement) Rules, 2016. In light of above, incomplete application cannot be processed and is required to be returned. If approved, application of the industry be returned with the request to the industry to apply for varied consents of the Board under the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981 alongwith varied authorisation under the Hazardous and Other Wastes (Management and Transbounary Movement) Rules, 2016 after attending the above said observations and complete documents and consent fee as required within 3 days.
