It is submitted that, earlier the industry was granted CTE (NOC) to the rice sheller under vide no. CTE/Fresh/LDH4/2023/21388909 dated 22.03.2023, which is valid upto 21.03.2024 with special conditions mentioned therein for paddy processing @ 04 TPH (with dryer) and production of Raw Rice with 32 Tonne/batch and Sortex Machine @ 2.67 TPH with by products as Rice Husk @ 0.80 TPH, Rice Bran @ 0.53 TPH respectively.
Now, the rice sheller has applied for fresh consent to operate under Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention & Control of Pollution) Act, 1981 for production of production of Rice @ 2.67 TPH with by products as Rice Husk @ 0.80 TPH, Rice Bran @ 0.53 TPH respectively after processing paddy as a raw material @ 04 TPH.
The industry has deposited consent fee Rs. 84000/- vide R. No. 434270482 dated 19.03.2024 under Air Act, 1981 and Rs. 42000/- vide R. No. 906744606 dated 19.03.2024 and Rs. 42000/- vide no/. 117328494 dated 20.03.2024 under the Water Act, 1974, against the C.A certificate of Rs. 140.00 lacs which is adequate up to 30.09.2033.
To verify the facts, the rice sheller was visited by the undersigned on 21.03.2024 and it was observed as under: -
1. During visit, rice Sheller was in operation.
2. The rice sheller has installed one shelling section and one dryer with individual cyclone separator as APCD.
3. The rice sheller has covered its processing sheds properly.
4. All the dust emitting points are properly hooded.
5. The rice sheller has provided adequate sampling arrangement with the APCD.
6. The rice sheller has provided adequate length and height of wall where rice husk is dumped.
7. The rice sheller is discharged its domestic effluent onto land for plantation after treatment through Septic Tank.
8. The rice sheller has developed plantation area along the boundary wall.
9. The work regarding brick paving of the movement area was under process.
10. The rice mill has submitted approved building plan from competent person of Director of Factories.
It is pertinent to mention here that as per Board’s letter no 5203-18 dated 28.02.2023, the competent authority of the Board has decided that the industry (only small scale) has submitted project report including feasibility report/dimensional drying of the Pollution Control Device(s) as per criteria fixed in the policy dated 30.04.2013, the completion certificate of pollution control device shall not be pressed for subject to the fulfillment of the following condition:-
1. An undertaking shall be obtained from the industry Small category) to the effect that Pollution Control Device(s) has/have been fabricated as per the dimensional drawing and the same is able to achieve the prescribed standards.
2. A condition shall be imposed that the grant of consent is subject to the monitoring of such Pollution Control Device(s) by the Board or any Government Laboratory/Government approved laboratory and in case the industry fails to achieve the prescribed standards, then consent to operate shall be revoked/cancelled without any notice.
The rice sheller is thus complying with the Water (Prevention & Control of Pollution) Act, 1974 and under Air (Prevention & Control of Pollution) Act, 1981 as well as code of practice laid down for such type of units.
Keeping in view of above mentioned facts, it is, therefore, recommended that renewal consent to operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the industry up to 30.09.2033 with suitable conditions as per the policy of the Board and special conditions that:-
1. The industry will submit analysis report of the process emissions during every processing season.
2. The industry will handle its fuel ash generates from the dryer furnace as per the provisions of Air Act, 1981.
3. The rice sheller shall pave the movement area before coming season.
