File Note: It is submitted that the industry was granted under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Varied/PTA/2021/15527040 dated 05/05/2021, valid up to 31.03.2024 and under the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2019/10738545 dated 25/10/2019, valid up to 31/03/2024 under red category, for production of Lager (Strong) & Mild Beer @ 1,666666.66 Lt/Annum & Wet Solids for Cattle Feed @ 30 MTD (by-product) by using Malt @ 35 MT/day, Rice @ 5 MT/day, Sugar @ 5 MT/day, Hops @ 50 Kgs/day as raw material subject to suitable conditions mentioned therein. As per the record file, the industry was visited by EE along with AEE of the Board on 22.06.2023 and contacted Sh. Alok Kumar Raut, Manager of the industry it was observed as under: 1. The industry was in operation. 2. The ETP installed by the industry was in operation. However, the secondary clarifier was filled with sludge. 3. The MEE installed by the industry was not in operation and the trade effluent after treatment in ETP and 2-stage RO was being discharged onto stagnation within the industrial premises. Effluent sample has been collected from RO reject and has been sent to Head office lab for analysis. 4. This stagnated effluent was also being discharged by the industry outside its premise through a pipeline near the main road causing stagnation. Effluent sample has been collected from this pipeline and has been sent to Head office lab for analysis. 5. The tank containing wet solids for cattle feed was also found leaking and the wet solids were also found stagnated into this stagnated effluent. 6. Also, stagnation of effluent was found along the banks of Bhakra canal flowing nearby the industrial premises. 7. The level of stagnation within and outside the industry was such that it could not be verified that whether the industry has laid any other pipeline for discharge of effluent outside its premises. 8. The industry is disposing off its plastic packaging material to unauthorized persons without obtaining plastic waste registration. Thus, the industry is violating the provisions of under Water (Prevention & Control of Pollution) Act, 1974 and Plastic Waste Management Rules, 2016. Accordingly, the industry was issued show cause notice for revocation consent to operate granted under the Water (Prevention & Control of Pollution) Act, 1974 as well as notice to issue directions u/s 33-A of the Water Act, 1974 issued to the industry vide Board’s letter no. 5800-01 dated 07/08/2023 alongwith opportunity of personal hearing before the Chairman of the Board on 22.08.2023. After hearing, it was decided that: 1. The industry shall deposit Environment Compensation amounting to Rs. 10 Lacs on the best assessment basis on polluter pay principle for the degradation of the environment made by it, within 7 days. 2. The industry shall submit a Bank Guarantee amounting to Rs.10 Lacs as an assurance to comply with the Environmental Laws, within 7 days. 3. The industry shall provide EMF meters at the various points such as intake of water in the process, wastewater generation, treatment in the ETP etc. and submit the water balancing to the Board, within one month. 4. Environmental Engineer, Regional Office, Patiala shall check the applicability of EPR/Registration under Plastic Waste Management Rules, 2016 and if found violating, recommend action under the said Act, separately. 5. Environmental Engineer, Regional Office, Patiala shall recheck the industry by constituting team of officers from Regional Office in the odd hours, within one month. 6. Further action shall be taken after the receipt of the report from Regional Office, Patiala. The proceedings of the hearing were conveyed to the industry vide Board's letter no. 7069-70 dated 12/09/2023. In compliance of the decision no. 1, the industry has submitted a Environment Compensation amounting to Rs. 10,00,000/- vide R.No. 73/5349 dated 26.09.2023 and as per decision no. 2, the industry has also submitted a bank guarantee bearing no. 0506223BG0000710 dated 25.09.2023 amounting to Rs. 10 lacs, valid upto 24.09.2024. Now, the industry has applied for obtaining for renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 alongwith requisite documents. The industry has deposited Rs. 528000/- vide UTR No. SBINR12024010694470788 dated 06.01.2024 as consent fee under the Water Act, 1974 and Rs. 528000/- vide UTR no. SBINR12024010694471172 dated 06.01.2024 as consent fee under the Air Act, 1981 against the fixed assets of Rs. 9420.09 lakhs as on 29.02.2024, which is adequate upto 31.03.2029. The industry has also deposited Rs. 165600/- as NOC regularization fee (Rs. 129600/- vide UTR No. SBIN524072365713 dated 12.03.2024 and Rs. 36000/- vide UTR No. SBINR12024010694470788 dated 06.01.2024), which is adequate for year wise increase in the value of the fixed assets. The industry has submitted vide its letter dated 04.01.2023, the following reasons for increase in the amount of fixed assets: 1. Installation of a new Beer filter in processing area for quality improvement which is highlighted yellow in color and a part of legend 'B'. 2. Expansion in Bonded ware house-2 from 1590 Sq meter to 2472 Sq meter (Legend 'O' in map) which is highlighted yellow in color. Scrap yard shifted to legend C. 3. Permission to use Universal tank no. 19 (600HL) as BBT. Which is already allotted to M/s Kimaya Himalayan Beverages LLP in Legend 'B' highlighted yellow in color. 4. Permission to open a gate in bottling hall All new changes from point no. 1 to 4 highlighted yellow color in Excise layout plan. With above alteration in brewery there is no increase in brewery annual production capacity. The industry has also submitted stack emission of boiler samples analyzed by NABL Accredited lab, Patiala on 29.12.2023, reveals that the particulate matter 72 mg/Nm3, which is within permissible limits as prescribed by the Board. Accordingly, the industry was visited by the EE alongwith AEE of this office on 18.03.2024 to verify the contents of the application and contacted Himanshu Vimal, Production Manager was contacted at site. During visit, it was observed as under: 1. The industry is a brewery unit & was found in operation. 2. The industry has installed 1 no. tube-well for abstraction of ground water, which is equipped with meter. 3. The industry is also using canal water as source of fresh water and is also maintain record of the same. 4. The industry has provided ETP for treatment of trade effluent generated from the plant, which is found in operation. 5. The treated effluent from ETP is further treated through ultra filtration followed by 2 RO's and then MEE. 6. During visit, UF, RO and MEE was found in operation. 7. The RO permeate from both the RO's is used for boiler make up water & for cooling purpose. 8. The RO reject of first RO is fed to second RO and reject of 2nd RO is fed to MEE. 9. During visit, the MEE was found in operation. The MEE condensate is used in cooling and MEE Concentrate is treated through ATFD. 10. The industry has installed MBBR based STP for treatment of its domestic effluent and same was found in operation. The reading of water meter is noted as 8147 KL. 12. The treated effluent of STP is discharged onto land for plantation in an area of 0.5 acre. 13. No stagnation or unauthorized outlet was observed at outside the industry during the visit. 14. During visit, effluent samples were collection from inlet of the ETP, outlet of the ETP, RO feed, combined RO reject, RO permeate, MEE condensate and MEE concentrate and sent to Head Office lab for analysis purpose. 15. The industry has installed 1 no. rice husk fired boiler of capacity 10.0 TPH, which is equipped with twin cyclone as APCD. 16. The stack emission sample of the boiler after APCD was collection JSO of the Board during the visit. As per above, the industry is found complying with the provisions of the Water Act, 1974, Air Act, 1981 and also with the decisions of the personal hearing held before the Chairman of the Board. In view of above, if approved, recommendations be may be sent to SEE, ZO-1 Patiala that: 1. Notice to issue directions u/s 33-A of the Water Act, 1974 may be dropped. 2. Renewal of consent to operate under Water Act, 1974 and Air Act, 1981 be granted to the industry upto 31.03.2029 with the usual conditions as per the policy of the Board.
