File Note: It is intimated that the poultry farm is a small scale (as per value of plant & machinery) green category unit and earlier, the poultry farm was granted consent to operate under the Water Act, 1974 vide no. CTOW/Fresh/BAR/2022/20155114 dated 31-10-2022 valid upto 31-12-2023 and under the Air Act, 1981 vide no. CTOA/Fresh/BAR/2022/19926546 dated 31-10-2022 valid upto 31-12-2023 for production of Eggs @ 35,000 Numbers/day & Feed Mill @ 6 T/day by using Chicks/Layer Birds @ 39,000 no./day & Maize, Soya, Mustard, Sun Flower, DOC, Bazra, Lime stone & GNE @ 6 T/day as raw material under small scale green category. It is intimated that the CPCB has framed Environmental Guidelines for layered poultry farms in August, 2021. As per the said guidelines, the poultry farms are classified as under: 1. Small (5,000-25,000 bird) 2. Medium (above 25,000-1,00,000 birds). 3. Large (above 1,00,000 birds) Now, the poultry farm has applied for varied consent to operate under the Water Act, 1974 and the Air Act, 1981 with same production but due to increase in value of machinery. However, as per the categorization of the industry into large/ medium/ small scale is being carried out by the Board on the basis of total value of the plant & machinery of the industry. The value of the plant & machinery of the poultry farm is 39.59 lakhs which is less than 5 cr, hence, it falls under small scale and competency to decide the case lies with Environmental Engineer, RO. The fee deposited by the poultry farm in previous granted application was adequate upto 30/09/2032. The poultry farm has deposited Rs. 420/- vide no. 171055075 dated 02.03.2024 as penalty fee under the Water Act, 1974 and Rs. 1120/- (Rs. 420/- as penalty fee + Rs. 700/- as NOC fee) vide no. 264217943 dated 02.03.2024 against the value of fixed assets of Rs. 96.67 lacs as per CA certificate dated 23.02.2024, which is adequate upto 30.09.2032. The poultry farm has submitted an undertaking regarding increase in value of machinery i.e. approx. 2 lacs, wherein it is mentioned that increase in machinery is due to exchange of DG set and cages. The poultry farm has not increase its production or land. To verify the facts, the site of the poultry farm has been visited by the officer of the Board on 11/03/2024 and it was observed as under:- 1. The poultry farm was in operation. 2. The poultry farm is located outside the phirni / laal lakir of village Khudi Kalan at the distance of more than 500 mtr and outside the MC limit. 3. The poultry farm has constructed 3 no. single story sheds for layered birds and 01 no. double story shed for chicks. The total capacity of the birds is 39,000. The poultry farm provided nipple system for drinking purpose of birds. 4. There is no approved residential zone, poultry/dairy, zoo sanctuary in the radius of approx. 500 mtr from the site of the poultry farm. There are 3 houses within 100-150 mtr of the poultry farm. There is no any water body and national highway in the radius of approx. 200 mtr, there is no drinking water source and state highway in the radius of approx. 100 mtr from the site of the poultry farm. 5. The poultry farm has provided the deep burial pit with cover for the disposal of dead birds. 6. The birds littering is supplied to the farmers as manure as free of cost by the poultry farm. During visit, no flies were observed at site. 7. The poultry farm has own feed mill with provided cyclone as APCD. 8. The domestic effluent generated from poultry farm was being discharged onto land for plantation after passing through septic tanks. 9. The poultry farm is not generating trade effluent. 10. Holding tanks are made for collection of water arising from the shed during washing. 11. The poultry farm has installed one D.G set of capacity 72 KVA with canopy. As per modified directions issued by CPCB u/s 18(1) (b) of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 regarding harmonization of classification of industrial sectors under red, orange, green, white categories vide its letter dated 07.03.2016 along with the "Final documents on revised classification of industrial sectors under red, orange, green & white categories" which also includes the consent period for which the consents are to be granted to red, orange & green category industries for 05 years, 10 years & 15 years respectively. In view of above, it is recommended that Consent to Operate under the Water Act, 1974 and the Air Act, 1981 may be granted to the poultry farm upto 30/09/2032 (upto adequacy of consent fee) with suitable conditions and with special condition that the poultry farm shall comply with the environmental guidelines/code of practice prescribed by the Board/CPCB.
