• It is submitted that the palace was granted consents to operate under the Water Act, 1974 and Air Act, 1981 vide nos. O16MKSCTOW4295987 and O16MKSCTOA4295907 both dated 27.07.2016, respectively valid upto 30.09.2020 for operation of marriage palace of 800 persons.
• The palace was visited by JEE of this office on 31.05.2022 and the observations are as under: -
1. No responsible person was present in the marriage palace and no function was being carried out during visit.
2. The palace has constructed oil & grease trap followed by septic tank with kitchen section to treat the domestic effluent arising from kitchen section. The palace has made provision to discharge the same into borewell.
3. The palace has constructed septic tank to treat the domestic effluent arising from toilet section. The palace has made provision to discharge the same into borewell.
4. The palace has not provided suction hoods alongwith adequate stack height in kitchen area.
5. The palace has not made scientific arrangement for handling of municipal solid waste/food waste generated during function.
6. The palace has installed DG sets of capacity 10 KVA, 50 KVA and 60 KVA without canopies and stack height.
7. The palace has not applied for renewal of consent to operate under Water Act, 1974 & Air Act, 1981 and is operating without valid consents to operate of the Board.
• The marriage palace was issued show cause notice for violation of provisions of the Water Act, 1974 & the Air Act, 1981 alongwith an opportunity of personal hearing before the Senior Environmental Engineer of the Board on 20.06.2022 and again on 08.07.2022. But neither any representative of the marriage palace attended the said hearings nor submitted any reply of show cause notice issued to it. The marriage palace was issued notice u/s 33-A of the Water Act, 1974 vide letter no. 3486 dated 15.7.2022 with an opportunity of personal hearing on 28.07.2022.Again neither any representative of the marriage palace attended the hearing nor submitted any reply in the matter.
• During hearing, it has been observed by Chief Environmental Engineer (B) that the marriage palace has failed to comply with the guidelines issued by the Board for control of pollution & enforcement of environmental norms in the marriage palace as well as not applied for renewal / extension of consents after the expiry of consents on 30.9.2020 and also failed to submit any response to the number of notices & opportunities of personal hearings afforded to it.
• After considering the material facts on file, it has been decided the Chief Environmental Engineer (B) that directions u/s 33-A of the Water Act, 1974 be issued for closure of the marriage palace and simultaneously, PSPCL authorities be asked to disconnect the electric connection of the marriage palace with immediate effect. Accordingly, directions u/s 33-A of the Water Act, 1974 were issued to the palace vide Board letter no. 4150 dated 26/08/2022 for its closure alongwith directions to PSPCL Authorities vide no. 4152-53 dt. 26.08.2022 for disconnection the supply of electricity available to the palace / premises. But no report has been received from the PSPCL authority for disconnection of electric connection. Accordingly, AEE PSPCL, Sri Muktsar Sahib was again requested vide this office letter no. 558 dt. 14.03.2023.
• Now, the marriage palace has applied for obtaining the consents to operate of the Board under the provisions of the Water Act, 1974 and Air Act, 1981. The consent to operate of the industry is valid for a period upto 30.09.2027.
• The palace was visited by undersigned on 21.03.2024 and it was observed as under-
1. No function was carried out in the palace at the time visit. The electric connection of the palace has been connected from transformer.
2. The palace has installed septic tank for treatment of domestic effluent generates from the sanitation section with provisions to discharge effluent onto land for plantation area. The palace has plugged the borewell.
3. The palace has installed grit chamber, oil and grease trap followed by septic tank for treatment of domestic effluent generates from kitchen section with provisions to discharge onto land for plantation area. The palace has plugged the borewell.
4. The palace has now provided suction hoods alongwith adequate stack height in kitchen area.
5. The palace has now provided 3 compost pits of size 3’x3’x7’ each for treatment of wet waste. Dry recyclable solid waste is being sold to kabarias.
6. The palace has placed DG sets of capacity 50 KVA and 60 KVA in an acoustic room and stack height has been provided with it.
The palace is now complying with the conditions of consents to operate under the Water Act, 1974 & Air Act, 1981. The compliance of guidelines is attached
Keeping in view of the above, it is recommended that fresh Consents to operate under the provisions of the Water Act, 1974 and Air Act 1981 may be granted to the palace for a period of one year along with issuance of directions to the PSPCL authorities to restore the electric connection please
