It is intimated that the industry is a medium-scale orange category unit. Earlier, the industry was granted consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Fresh/SAS/2023/24008121 dated 02.11.2023 and the Air (Prevention & Control of Pollution) Act, 1981 vide no. CTOA/Fresh/SAS/2023/24007068 dated 02.11.2023, both having validity upto 31.03.2024 for manufacturing of Ice Cream Cup @ 640000 No./Day & Curd Cup @ 960000 No./Day by using Hight Impact Polystyrene @ 6000 Kgs/day with subject to suitable conditions and special conditions mentioned therein.
Now, the industry has applied for obtaining renewal of consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 for same production and raw material along with requisite documents.
As per record file of the industry the previous consent fees are adequate upto 30.09.2028 against the total cost of fixed assets is Rs. 16.67 crores. Now, the industry has deposited Rs. 53,300/- vide R. No. 201955245 dated 18.03.2024 (Rs. 28,800/- under the Water Act, 1974, Rs. 24,000/- as balance fee) and Rs. 56,200/- vide R. No. 669094746 dated 18.03.2024 (Rs. 28,800/- under the Air Act, 1981, Rs. 24,000/- as balance fee & Rs. 2,900/- as NOC regularization fee) against the total cost of fixed assets is Rs. 24.36 crore as on 29.02.2024. The consent fee deposited by the industry is adequate upto 30.09.2029 under both acts after adjusting NOC fee and balance fee.
The industry was visited by AEE of this office on 21.03.2024 and it was observed as under:
1) The industry was in operation during the visit.
2) The industry is using High Impact Polystyrene granules as raw material.
3) The manufacturing process of the industry is as under: -
Raw Material—Extrusion—Thermoforming—Printing—Ready.
4) The industry is using only using virgin granules and all the machinery is electrically operated.
5) There is no source of trade effluent and the industry has installed STP based on MBBR technology for treatment of domestic effluent and the treated effluent is being discharged onto land for plantation.
6) As per record maintained by the industry about 1.5 KL of domestic effluent is being treated in the STP.
7) There is no source of air pollution and the industry has not installed any D.G set.
The industry has applied for obtaining registration under EPR as per Plastic Rules, 2016 vide registration no. 2023120107544848676 on dated 07.12.2023, which is under process.
In the view of above, it is recommended that the 'Consent to Operate' under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.03.2029, subject to suitable conditions and additional conditions that:
1. The industry shall only use virgin plastic granules as raw material in the process.
2. The industry shall not carry out any activity in its premise, which can change the category of unit from Orange to Red, without prior permission from PPCB.
3. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
4. The industry has been approved by the Board from pollution angle and the industry shall obtain the statutory clearances / permissions from all other concerned departments.
5. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
6. The industry shall comply with the provisions of Solid Waste Management Rules, 2016.
7. The industry shall obtain the authorization under the Hazardous and Other Wastes (Management and Transboundary Movement) Rules, 2016.
8. The industry shall comply with the provisions of Plastic Waste Management Rules, 2016.
9. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
10. The industry shall ensure that the activities of unit does not create any nuisance in the surrounding areas and no public complaints are received.
11. The consents is being issued to the project proponent based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry/project proponent and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time, without any opportunity of Personal Hearing.
12. In case the project proponent fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the project proponent.
13. The industry shall ensure the compliance of provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to him and Rules, Circulars & Directions issued by the Board from time to time.
