The report of the Regional Office has been examined and observed as under: -
1. As per the decisions of the personal hearing given to the industry on 07.12.2023, the industry shall obtain revised consents under the Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act, 1981 without any wet process. However, the industry has again applied to obtain consent for generation / disposal of trade effluent.
2. As per the decisions of the personal hearing given to the industry on 07.12.2023, the industry shall shift its unit on PNG by 15.01.2023, but it has not complied the decision so far.
3. As per the decisions of the personal hearing given to the industry on 07.12.2023, the industry shall carryout CER activity amounting to Rs. 1.0 lacs, within one month, but the same has yet to be carried out.
4. Lastly, the stack emission samples were not complying with the standards and as per the decisions of the personal hearing given to the industry on 07.12.2023, the Regional Office shall collect the fresh samples within one month, which has also not carried out, so far.
As such, in view of above, it is clear that neither the industry has made complete compliance of the decisions of the hearing, nor the Regional Office has collected the stack emission samples.
Therefore, the applications of the industry cannot be considered at this stage and Regional Office may be asked to return the applications to the industry with direction to immediate make the compliances of the decisions and Regional Office be collect the samples within 07 days, positively.
