It is submitted as under:
1. The applicant applied for obtaining CTO for operation of a warehouse on 21.02.2024 under the Water Act, 1974 and the Air Act, 1981.
2. The godown/warehouse was visited by AEE of Regional Office, Patiala on 26.02.2024 and observed that the godown/warehouse has two no. sheds, one off built up area of about 2.2 lac sq.ft and other an area of about 1.8 lac sq. ft. (total of about 4.0 lac sq. ft i.e. 37,000 sq. mtrs). Also, unscientific disposal of wastewater intimated by the representative of the godown/ warehouse.
3. As such, SCN for refusal of consent to operate under the Water Act, 1974 and the Air Act, 1981 were issued to the godown/ warehouse vide letter no. 12698 & 12716 dated 14/03/2024 respectively within an opportunity to reply to the show cause notice within 10 days.
4. Now, the godown/ warehouse has submitted its reply on 18.03.2024 to the show cause notice issued to it. However, the reply of the godown/ warehouse is not complete as the godown/ warehouse has submitted building plan of one shed out of the total two sheds and has made wrong statement it has only shed in its premises. Secondly, the godown/ warehouse has given reply regarding wastewater treatment of domestic wastewater generated by it.
5. Also, the godown/ warehouse has given representation through its email dated 22.03.2024 that it has not got deemed approval certificate till date and has submitted that the Board was bound to issue deemed certificate to the godown/ warehouse.
Keeping in view of above, it is recommended as under:
a) Consents to operate applied by the godown/ warehouse may be refused due to reasons mentioned above.
b) Regarding representation dated 22.03.2023 of the godown/ warehouse, it may be informed to the godown/ warehouse that show cause notice for violations of the provisions of the Water Act, 1974 and the Air Act, 1981 was issued to it within 15 working days in compliance to the circular regarding deemed approval of the Board. |
