The above note may kindly be perused.......
Earlier, notice u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 was issued to the industry alongwith opportunity of personal hearing before Chief Environmental Engineer, Ludhiana on 20.07.2021, wherein it was decided that: 1. The industry will operate its APCD properly and efficiently and not emit black smoke in future. 2. The industry shall submit Bank Guarantee of Rs. 1 Lac as an assurance to comply with pollution control laws, within 15 days. 3. The industry will focus one of the CCTV cameras towards the stack and ensure that same is connected with the Board’s server, within 10 days. 4. The industry will submit proper agreement for disposal of fuel ash in environmentally sound manner within 15 days. 5. Regional Office shall collect stack emission samples of the industry within 15 days to check the adequacy of APCD. 6. Regional Office will visit the industry to verify the contentions submitted during hearing and report whether any emissions of black smoke have been observed from the stack of the industry during routine visit to the area in the last six months, along with further recommendations in the matter, within 15 days..............
The industry has not submitted Bank Guarantee of Rs. 1 Lac as per decision no. 2 above.........
Accordingly, scn for refusal of consent was issued to the industry.....Also RO was asked to comment upon the compliance of decisions of the personal hearing afforded to the industry by CEE,L on 20.07.2021.......
No reply was received by the industry to the scn issued to it...........
Also no bank guarantee has been submitted by the industry till date......
Further, RO Keeping the above in view, it is recommended that 'Consent to Operate' under the Air Act, 1981 may be refused..........
Further, on a separate e-noting RO be asked to initiate case for issuing directions u/s 31-A of the Air Act, 1981 after incorporating all the details and compliance of all the decisions of the hearing afforded to the industry before the CEE on 20.07.2021........
