• The industry was earlier granted consents to operate under the Water Act, 1974 & Air Act, 1981 for processing raw milk @ 50 KLD on 13.07.2018 (valid upto 30.06.2023) under the name & style of M/s M.C. Traders (in a land area of 04 kanal 05 marals) for discharge of trade effluent @ 90 KLD and for installation of 2 wood fired boiler of capacity 900 kg/hr and one rice husk fired boiler of capacity 4 TPH………...
• Now application applied under the name& style of M/s M.C. Food and Nutrition for processing of raw milk @ 160 KLD. Land area increased to 39 kanals 17 marlas. ETP installed of capacity 200 KLD. New boiler installed of capacity 08 TPH and 04 TPH alongwith 2 baby boilers of capacity 900 kg/hr…………….
• The DTP, Moga vide its report bearing no. 165 dated 19.02.2024 has mentioned that site falls in the notified Local Planning area Nihal Singh wala and Badhni Kalan, the master plan of which is yet to be prepared and no zone has been specified till date. Milk processing unit (Red category) is permitted provided that in case the site falls in the non-confirming zone while finalization the master plan then the project proponent shall be bound to abide by provisions of the Master Plan and shall also be bound to follow the provisions of section 79 alongwith other provisions of PRTPD Act, 1995……...
• The report has also been received from SDM, Nihal Singh Wala vide its office letter no. 97 dated 27.02.2024, wherein it has been mentioned that the land area of 39 kanal 17 marlas does not fall within 100 meter of any Nagar Panchayat, Village Phirni/lal lakir, Educational Institute, Residential Colony or Pucca houses………..
• The visiting officer has reported that the industry was visited on 05.03.2024 and observed that:-……….
a. The industry has made expansion and was in operation at its full capacity. The land area of 39 kanal 17 marlas does not fall within 100 meter from any village phirni, residential area (cluster of 15 houses), educational institute and the site is suitable for regularization…………..
b. The industry has upgraded its ETP to 200 KLD and was found in operation for treatment of its effluent. The treated effluent is discharged onto land for plantation developed in 02 separate pockets with total area of 04 acres (02 acres on lease and 02 acres of the project proponent) at about 300 meters from the ETP through an underground pipeline. The condition of the plantation area was found good. The plantation area was earlier common with its sister concern unit namely M/s Shankar Rice & General Mills, which was a saila plant, but now engaged in the production of only steamed rice………….
c. The industry has installed new boiler of capacity 08 TPH & 04 TPH with separate cyclone as APCDs along with 2 baby boilers of capacity 900 kg/hr each, however the same are not in utilization………...
d. No violation reported under the Water Act, 1974 & Air Act, 1981………..
• In view of above, if approved, CTO under the Air Act, 1981 be granted to the industry for a period upto 31.03.2029, subject to the following special conditions that:-…………..
1. The industry will operate its ETP regularly & scientifically and shall maintain the proper record of the effluent generated/ treated………….
2. The industry shall ensure proper availability of the land area for disposal of treated effluent at all times; will ensure no stagnation in the said plantation area at any time and will be bound to increase the same if stagnation is observed in it at any time………..
3. The industry will get its effluent/emission samples analyzed from the Board's lab/Approved lab of the Board, within 03 months………..
4. The industry will not undergo any expansion w.r.t. land area/production capacity without prior written permission of the Board………..
