File Note: It is submitted that the project proponent is setting up a Residential Colony in the name of "California Estates" and has applied for obtaining fresh Consent to Establish (NOC) under the Water Act, 1974 and Air Act, 1981 under red category in the revenue estate of Village Bakshiwala, Bhadson Road District Patiala developed M/s Metro Developer & Builders, SCO-13, Phase-11, Mohali. The project proponent has submitted requisite supporting documents i.e. application form, feasibility report, project report, copy of CLU issued by office of the competent Authority-Cum-Chief Administrator, PDA, Patiala under PAPRA Act, 1995, land documents; location plan, propose map, partnership deed etc. Project Report: As per the project report submitted by the project proponent the total proposed cost of the project is 44.32 cr. Land Documents: The project proponent has submitted copy of land registry according to which the land on which the colony has to be developed is given by Surinder Pal Singh S/o Gurdev Singh, Jaswinder Kaur W/o Kuldeep Singh, Karamjit Kaur Litt D/o Maghar Singh R/o Burj Littan, Sahib Singh S/o Balwant Singh, Sarabjeet Singh S/o Balwant Singh to M/s Metro Developer & Builders, SCO-13, Phase-11, Mohali. The copy of land registries and letter of consent is attached. CLU/ LOI: The project proponent i.e. M/s Metro Developer & Builders, SCO-13, Phase-11, Near Mandi Board Office, SAS Nagar (Mohali) has obtained transfer of Change of Land Use (CLU) and issue of Letter of Intent (LOI)/Lay Out Plan for setting up a Residential Colony in the name of "California Estates" in an area of 65.556 Acres (524 Kanal, 09 Marla) at Village Bakshiwala (H.B no. 353), Bhadson Road District Patiala from the O/o the Competent Authority-Cum-Chief Administrator, PDA, Patiala vide memo no. PDA-Admn.A-2-2023/280 dated 03.01.2024. As per the LOI grant a License is for setting up a residential colony namely "California Estates" at Village Bakshiwala, Bhadson Road District Patiala of in an area of 65.556 Acres (524 Kanal, 09 Marla) as per the Layout Plan technically approved by the Senior Town Planner, Patiala vide his letter No. 1705/STP(P)CP. 182 dated 07-12-2023 and 1807/STP(P)CP-182 dated 21-12-2023, Drawing No. CE/CDS/03 Dt. 18-12-2023. The project has to be established in Khasra No. 95//6(7-8), 14/1(2-0), 15(8-0), 16(8-0) 17 (8-0), 23(8-0), 24(8-0), 25(8-0), 96//10/2(1-11), 11(8-14), 20/(8-0), 21(8-0), 99//1(8-0), 2/2(3-2), 9(8-0), 10(8-0), 11(8-0), 12(8-0), 20(8-0), 21(8-0), 100//13(8-0), 4(8-0), 5(8-0), 6(8-0), 7(8-0), 8(8-0), 13(8-0), 14(8-0), 15(8-0), 16(8-0), 17(8-0), 100//18(8-0), 19/2(1-11), 22(8-0), 23(8-0), 24(8-0), 25(8-0), 110//5(7-8), 6(5-16), 15(8-8), 111 //1(8-0), 2(8-0), 3(8-0), 4(8-0), 5(8-0), 7(8-0), 8(8-0), 9(8-0), 10(8-0), 11(8-0), 12(8-0), 13(8-0), 14(8-0), 17(8-0), 18(8-0), 19(8-0), 20(8-0), 21(8-0), 22/1(2-4), 22/2(5-16), 23(8-0), 24/1(4-4), 24/2(3-16), 112//1/1(3-2), 124//1(7-11), 125//3(6-12), 4(7-7), 5(7-11) in an area 65.556 Acres (524 Kanal, 09 Marla) subject to conditions mentioned therein. As per the application, the proposed date of commissioning is January, 2030. Consent fee The project proponent has deposited Rs. 72500/- (Rs. 72000/- as NOC fee and Rs. 500/- as application form fee) vide Receipt No. 390268307 dated 14.03.2024 fee against the project cost of Rs. 4432.00 lakh as per project report. This NOC fee is adequate for one year. Requirement of EIA, 2006 The land area is about 65.556 acres or 264212 sqm (as per application) and total built up area is 283210 sqm as per the application, which is more than 1.5 lakh sqm. Therefore, the project is covered under EIA notification dated 14.09.2006. Although all plots cannot be 2 bed room dwelling unit but the proposal of fresh water consumption on the above basis can be considered as the project proponent has proposed to install MBBR based STP of 1150 KLD capacity which is adequate to take additional load of domestic effluent when calculate on actual basis. The project proponent has proposed to reuse treated waste water @196 m3/day and shall discharge 282 m3/day onto land for plantation as per Karnal Technology in an area of 16334 sqm or 4.03 acres (Hydraulic loading 70 KL per acre). The project site was visited by the undersigned on 15.02.2024 and contacted Sh. Ankur Singla, partner at site. During visit, it was observed as under 1. The proposed site falls on the left-hand side of the Patiala-Bhadson Road near Village Bakshiwala, Tehsil & District Patiala. 2. The project proponent has demarcated the boundaries of the proposed project site with concrete boundary wall. 3. No construction activity pertaining to the project has been started. There is no air polluting industry within a radius of 100 m from the boundary of the project site and there is no MAH industry within a radius of 250 m radius from the boundary of the proposed site. Therefore, the site of the project is conforming to the sitting guidelines laid down by the Govt. of Punjab, Department of Science, Technology and Environment vide order dated 25/7 / 2008 as amended on 30/10 / 2009. In a clarification vide Board letter no. 4426-49 dated 05.02.2009, in which it was mentioned that the prescribed distance are to be maintain or not from the various category of above mentioned industries (i.e. rice shellers/saila plant/stone crushers/brick kilns/cement plants/cement grinding units/hot mix plants) for establishments of residential colonies/commercial establishments, was discussed in a meeting held under the chairmanship of Chief Secretary, Punjab on 13.01.2009 and it was decided as under: a) The distance of 500m and 300m as prescribed in the above mentioned notification for establishment of rice shellers/saila plants/stone crusher and brick kilns/cement plants/cement grinding units/hot mix plants, respectively, would be maintained by the new residential colonies to be established outside the local planning area(LPA) i.e. these notifications would be deemed to be operative vice-versa also. b) The residential/commercial establishments shall be allowed within the Local Planning area as per the land use prescribed in the master plan/draft master plan of the area irrespective of their distance from the rice shellers/saila plants/stone crushers/ brick kilns/ cement plants/ cement grinding units/ hot mix plants. However, minimum buffer of 15m green belt of broadleaf trees should be provided by the colonizer towards the air polluting industries, boundary of which are located within 100m from the boundary of such projects. The site falls within LPA of notified master plan, Patiala and no Rice shellers / saila plants/stone crusher and brick kilns/cement plants/cement grinding units/hot mix plants is located within 100 mtr of the project site. In this case, the project proponent has obtained transfer of Change of Land Use (CLU) and issue of Letter of Intent (LOI)/Lay Out Plan for setting up a Residential Colony and no air polluting industry is located within 100 mtr of the said site. The site is suitable for establishment of the project. In view of above, if approved, SEE, ZO-1, Patiala may be recommended that consent to establish/NOC be granted to the project proponent for one year with the suitable conditions. 1. The project proponent shall obtain prior Environment Clearance, as per EIA notification 14.09.2006 amended from time to time before start of construction activities. 2. The project proponent shall develop the project in the Khasra no. mentioned in the PDA letter no. PDA-Admn.A-2-2023/280 dated 03.01.2024. 3. The project proponent shall install STP as proposed in the application submitted by it. 4. The project proponent shall not discharge any treated/untreated wastewater into any drain/inland surface water and shall make arrangements for utilization of treated wastewater onto land for plantation/irrigation. 5. The project proponent shall properly handle and manage the solid waste as per the provisions of the Municipal Solid Waste Management Rules, 2016 and ensure that the solid waste is segregated Into biodegradable and non-biodegradable components. The biodegradable component shall be treated by providing mechanical composter to produce compost, which will be disposed of/reused in an environmentally sound manner and the non- biodegradable solid waste shall also be disposed of in an environmentally sound manner. 6. The project proponent shall comply with the provisions of E-Waste Management Rules, 2022 in true letter and spirit. 7. The project proponent shall comply with the provisions of Plastic Waste Management Rules, 2016 in true letter and spirit.
