It is submitted that the subject cited hospital was granted consent to operate under Water (Prevention & Control of Pollution) Act, 1974 vide no. CTOW/Renewal/PTA/2022/15717017 dated 02/12/2022, valid upto 31/12/2023 and under the Air (Prevention and Control of Pollution) Act, 1981 vide no. CTOA/Renewal/PTA/2022/15717108 dated 02/12/2022, valid upto 31/12/2023 for 30 beds with suitable conditions subject to conditions mentioned therein.
The HCF had already deposited Rs. 11000/- (Rs. 10000/- consent fee + Rs. 1000 Penalty fee) vide Receipt No. 560543218 dated 21.11.2022 under Water Act, 1974 and Rs. 11000/- (Rs. 10000 consent fee + Rs. 1000 Penalty fee) vide Receipt No. 949484727 dated 21.11.2022 under Air Act, 1981, which was adequate upto 31.03.2029.
Now, the hospital has applied for renewal of consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and under the Air (Prevention & Control of Pollution) Act, 1981 for 30 no. beds along with requisite documents. The hospital has obtained auto renewal authorization under Bio-Medical Waste Management Rules, 2016, which is adequate upto 13.02.2029.
The hospital representative informed that they were unable to file auto renewal application due to some technical issues and filed renewal application instead.
The HCF has entered into an agreement with M/s Rainbow Environments Pvt. Ltd., Mohali dated 30.01.2023, for generation, collection, storage and disposal of bio-medical waste generated, which is valid upto 31.03.2027 for 30 beds.
The HCF has submitted compliance report of consent conditions earlier granted to it under the Water (Prevention and Control of Pollution) Act, 1974 and the Air (Prevention and Control of Pollution) Act, 1981.
The hospital has already submitted effluent sampling reports and analyzed by M/s Punjab Biotechnology Incubator, Mohali on 31.10.2022. As per the report, the concentration of particulate matter is pH=7.88mg/l, COD=34mg/l, BOD=4mg/l, TSS=20.2mg/l, TDS=910mg/l, O&G= BDL mg/l and Bio-Assay= survival in 100% effluent after 96 hr of testing, which are within the permissible limits as prescribed by the Board.
It is pertinent to mention here that the Board vide office order no. 329 dated 14.09.2023 in suppression of Board’s office order no. 443 dated 09.08.2021 has decided to facilitate the entrepreneurs with auto generated of renewal of consent to establish/ operate /authorization of any category of small scale industries / projects / Health Care Facilities (upto 50 beds) and hazardous waste generating industries on the basis of self-declaration by these entrepreneurs and shall be without any inspection / physical verification by the officers of the PPCB.
As per the Board’s office order no. 379 dated 27.10.2023, it has been decided that HCFs up to 30 bed capacity, which are discharging their liquid waste into public sewer and operating within MC limits of towns, where terminal sewage treatment plant (STPs) have been installed, shall be granted consents to operate under the Water Act, 1974 and the Air Act, 1981 as well as authorization by PPCB without installation of individual ETP, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the MoEF&CC under BMW Rules, 2016 as amended upto the date and subsequent amendments if any.
In this case, the hospital having 30 beds capacity falls within M.C limits of Patiala and the outlet of the HCF is connected to sewer (water bill attached), which is further connected to terminal STP.
Keeping above in view, it is recommended that consent to operate under the Water (Prevention and Control of Pollution) Act, 1974 and Air (Prevention and Control of Pollution) Act, 1981 may be renewed to the hospital upto 31.03.2029 subject to certain conditions mentioned in the original letter and following special conditions:
(1) The hospital shall not carry out any expansion/ modernization/ change in process/ category (from green to orange or to red or so on) or out scale (from small to medium or large) without obtaining prior permission of the Board.
(2) In case the hospital is found that it has submitted any wrong/ partial/ forged information/ document or any false affirmation, it shall be liable for action as deemed fit by the Board under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 and BMW Rules, 2016.
(3) The consent to operate is being granted without installation of individual ETP, as an interim arrangement, subject to the condition that HCFs shall ensure to comply with the effluent standards as notified by the MoEF&CC under BMW Rules, 2016 as amended upto the date and subsequent amendments if any. |
