It is submitted that the industry is a small scale green category unit. Earlier, the industry was granted Consent to Establish (NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981 vide no. CTE/Fresh/SAS/2023/24082212 dated 07.11.2023 having validity upto 30.10.2024 for manufacturing of Tractor Parts, Tractor rotavator gearbox, Tractor rotavator & Job work @ 9.3 MTD by using CI Casting @ 10 MTD as raw material with subject to suitable conditions and special conditions mentioned therein.
Now, the industry has applied for obtaining fresh consent to operate under Water (Prevention & control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for same production capacity and raw material along with requisite documents and fee.
The industry has deposited Rs. 42,000/- vide Receipt No. 400971543 dated 26.03.2024 under Water Act, 1974 and Rs. 42,000/- vide Receipt No. 944562711 dated 26.03.2024 under Air Act, 1981, against the fixed assets of Rs. 262.36 lacs as on 25.03.2024. The consent fee deposited by the industry is adequate upto 31.12.2028 under both acts.
The industry has submitted the copy of electricity installation as proof of commissioning, as per which the date of installation of electricity is 12.03.2024.
The industry was visited by the officer of the Board on 27.03.2024 and it was observed as under:
1) The industry was not in operation during the visit and will be engaged in the process of manufacturing of Tractor Parts, Tractor rotavator gearbox, Tractor rotavator & Job work .
2) The manufacturing process of the industry is as under: -
CI Casting—Horizontal Machining Center (HMC)—Vertical Machining Centre (VMC)—Testing—Dispatch.
3) There is no source of trade effluent and domestic effluent is being discharged into PSIEC sewer.
4) The industry has installed 1 no. DG set of capacity 50 KVA, which is equipped with canopy and adequate stack height.
5) The industry has submitted the approved site plan by Assistant Town Planner, PSIEC dated 13.02.2023.
The industry is complying with the conditions of Consent to Establish (NOC) for an industrial unit u/s 25 of Water (Prevention & Control of Pollution) Act, 1974 and u/s 21 of Air (Prevention & Control of Pollution) Act, 1981, earlier granted to it.
In view of above, it is recommended that the consent to operate under the Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act, 1981 may be granted upto 31.12.2028 with suitable and special condition that:
1. This consent is only valid for manufacturing of Tractor Parts, Tractor rotavator gearbox, Tractor rotavator & Job work @ 9.3 MTD by using raw material CI Casting @ 10 MTD.
2. The industry will stick to the production capacity mentioned in this consent and will not increase the same without prior written permission of the Board.
3. The industry shall not carry out any activity in its premise, which can change the category of unit from Green to Orange/Red, without prior permission from PPCB.
4. The project proponent shall not discharge any effluent at any unauthorized place by any unauthorized means i.e. shall not discharge any wastewater in any drain / inland surface waters / drain/choe/nallah/ onto land for stagnation or outside its premises, at any time, under any circumstances.
5. The industry shall ensure that the activity of unit does not create any nuisance in the surrounding areas and no public complaints are received.
6. The industry shall apply for obtaining authorization under the Hazardous and Other Wastes (Management and Trans-boundary Movement) Rules, 2016.
7. The Consent is being issued to the industry based upon the documents/ information submitted by it along with the online application form. The Board would be at liberty to take penal action against the industry and its responsible/ concerned person(s) in case information/document is detected as incorrect/false/misleading at any point of time.
8. In case the industry fails to comply with the provisions of the Water (Prevention & Control of Pollution) Act, 1974, Air (Prevention & Control of Pollution) Act, 1981, Environment (Protection) Act, 1986 and/or any other environmental law applicable to the project and Rules, Circulars & Directions issued by the Board from time to time, action as deemed fit shall be taken against the industry.
